    "After being banned from the PlayStation Network for hateful comments stated in Resistance's online community, Erik Estavillo launched not one, but two, lawsuits against Sony for infringing on his "first amendment rights" -- an argument that was shot down by Judge Ronald Whyte simply because "Sony is not part of the government."

    However, what Estavillo lacks in civil online discourse, he makes up for with sheer determination and persistence. In addition to Sony, he now has both Microsoft and Nintendo in his sights. Estavillo is seeking $75,000 from Microsoft for the "undue stress" and "sadness" caused by his Xbox 360's RROD. "Microsoft should have to bear the burden that is now put on the shoulders of this disabled plaintiff," his claim states -- a burden that is equivalent to the sum of 375 Xbox 360 systems, apparently. Nintendo is being sued for interfering with Estavillo's "pursuit of happiness." And how exactly is Nintendo doing that? "Deleting, blocking or prohibiting the Homebrew Channel and Ocarina applications" via a system update.

    We're hoping you can see the sheer brilliance of Estavillo's strategy. He's offering the perfect opportunity for PlayStation, Xbox and Nintendo fans to agree on something for once."

    ...holy shit, some one is actually more dumb than the people suing Microsoft for banning their modded consoles.

    That made my day. I like it how people sue over everything. Makes me kinda regret not getting into law.

    He's being smart about it.

    $75,000 is enough that it would be a nice payday for a college kid with a cheap lawyer (figure half of that would go to legal fees) on contingency.

    It's also LOW enough that a large corp is likely to consider settling just to avoid its own legal costs.

    While professionalism has it that I reserve bashing the crap out of things, Erik Estavillo is really asking for it. Let's face it, the guy is on a suing spree from hell. Estavillo, more commonly known as "the banned Resistance player that sued Sony, Microsoft, and Nintendo", is now turning his eyes to Blizzard, which is responsible for the evil moneymaker, World of Warcraft.

    To help make his case, he turns to Depeche Mode's Martin Lee Gore and Winona Ryder - you'll know how that "makes sense" in just a bit.

    Estavillo filed a civil complaint charge this morning against ActiBlizz which he claims to have "deceitful" business practices, which “continues to maintain a harmful virtual environment to many of its customers by forcing them to follow the game’s sneaky and deceitful practices.”

    According to Estavillo, World of Warcraft was designed “to walk or run at a calculated slow pace, resulting in the player taking longer to get where he or she needs to go in the game.” The slow walking, therefore, prolongs the gaming process, resulting in more subscription revenues.

    Estavillo then turned again to his health problems - OCD, Agoraphobia, Panic Disorder, major depression and Crohn’s Disease - to what led to the suicide of EverQuest player, Shawn Woolley. He “doesn’t want to end up like Shawn did as he [Estavillo] relies on videogames heavily for the little ongoing happiness he can achieve in this life.”

    And to put the cherry on the ice cream, Estavillo subpoenas Martin Lee Gore and Winona Ryder to testify on his behalf regarding alienation. He explains that "he (Gore) himself has been known to be sad, lonely, and alienated as can be seen in the songs he writes."

    As for Winona, Estavillo reasons using JD Salinger's Catcher in the Rye - a common interest between him and her. According to him, Ryder will be able to “explain the significance of alienation in Catcher in the Rye and will also testify to how alienation in the book can tie to alienation in real live/video games such as World of Warcraft.”

    The banned Resistance player is now asking for US$ 1 million in punitive damages and a court order for Blizzard to make the WoW characters walk faster.

    I should be ashamed that I'm still laughing.

    In his defense, this is true. WoW et al are designed to be time sinks, so that the player spends more time of their life in the game and thus more on subscription.
