Blatant thievery, an open letter.

    Dealing with a user dispute / banning has lead me down a dark path.

    The person was sold a beta of something that should have not been copied.
    He split the price with someone and never reimbursed them. This issue is settled.
    However, this revealed a deeper problem.

    How can I say this.

    If you own a beta, a pressed beta or hard drive data (whatever it is) it is
    morally wrong and a slap in the face of all we stand for to solicit the sale
    of the original item and sell copies of it on the side at the same time.

    It is just as serious to own the original and sell copies as beta originals,
    even if you do it just once so you can keep the original for yourself.

    Transfer of ownership is complete and TOTAL. There is no "and one for myself".

    Unrelated but as serious:

    If you have data from this site, xbox underground or any other source
    and try to EXPLOIT the naivety of new users here, or anyone on another site by
    selling copies we will find out, God help you.

    There will be NO accusations, names, etc.

    This is a clean slate for people to be reminded that old actions can haunt them later.

    These problems originated YEARS ago and are now causing problems.

    It's unethical, and pretty much fraud. Saying that it's one of a kind, but really isn't because you have copies for yourself to sell in the future, then yeah I see how it is fraud.

    Well I mean this applies to any industry too. Copying of software is a federal offense because it screwes the developers out of money, your not losing anything by making copies only gaining which is exploitation. Same lesson applies here, if you have a rare item, selling then keeping a backup can allow you to make more backups and sell those. Obviously the whole situation is a exploitation of the fact that there is no law in rare trade, gives one a sense of invulnerability. I'm glad you laid down the ground rules Assembler but I don't think it will stop people like this in the long run because well frankly, these people have unethical practices.

    I can understand maybe keeping a copy for yourself, but not selling copies - that's just wrong. It's like that YamYam Gold dude, how long do you think you can get away with it before you get caught?

    While I ABSOLUTELY AGREE with the sentiment of this thread, do you think the devs got any money for the beta?

    No no, you misunderstand. I was using that to explain why it is illegal in standard law whilst comparing it to rare trade. In other words, there is a good reason why making copies of software is illegal because you can distribute software freely and gain a substantial amount of money, I stated the developers being screwed out of pay as a bonus explanation for the law, does not apply to my rare trade point. Sorry for the confusion, I could have certainly worded that better.

    Well you must understand this however, This can be seen as exploitation because your not losing anything, only gaining profit. Its like counter fitting a large sum of money and buying a car with it while keeping the original sum. Even if you only do it once the outcome is still the same. Its basically cheating the rare-trade market. Its just a very gray area to argue and can't really be seen as black or white because in the end its all about ethics and your personal idea of fair.

    It's all well and good making backups for something you own while you own it but if you then sell the item in question and keeping the back ups that's just rude. What's to stop you from releasing/selling the back ups in the future thereby plummeting the value of the item you just sold.

    Of course it will bite you and you'll never be let in the community again.

    Some kid tried selling/trading betas that were freely available. He got caught out and banned. That's about it, actually. I think it would be worth mentioning his aliases here but since Assembler's post says no accusations/names, I'll leave it out.

    Ethics, perhaps? Anyone who's prepared to to sell copies after the sale is already a dick, why wouldn't they keep the original and sell copies on as originals?

    Personally, I don't think that keeping a copy of a proto after the trade can honestly be said to decrease the value of the original item, so long as they keep it to themselves; it's just a matter of personal morality whether or not you're honest enough to delete your backups. Either way, I'm willing to bet people regularly keep them after the trade.
