I have no idea where to put this so it's in OT. Yet another person has fallen victim to YT's bullshit policies, and this time it's one of our members. Bronzed_Mario3's youtube channel, "everythingsupermario", dedicated to the preservation of rare and obscure Mario media such as the elusive "Super Mario Bros.: Peach-Hime Kyushutsu Dai Sasuken!" was taken down not too long ago for unknown reason, presumably for Copyright infringement. Although the media in question IS copyrighted, I believe it could be put under fair use for preservation and/or education. I've seen too many good channels taken down for bullshit reasons and this is one example. He's emailed Youtube about it but they haven't responded yet. There were no warnings or strikes at all. I cannot stand Youtube's whole system. If anybody can help AT ALL it would be extremely appreciated. Thank you.
They just revised content creation terms for "Creators". Nintendo also has some really barbaric views of Youtube (to explain - when I talked to Lab Zero at AX about this, they shared that when working with them for a brief time, it showed that Nintendo essentially views YT as a form of piracy site but in the visual medium to put it roughly) The copyright system is also a bit weird. You can have copyrighted content in your videos, but if so you can't monetize it. The content that is usually protected is music. In games this is usually tough since it's part of the game itself. Normally game footage can get copyright notices, but not strikes (try uploading a video of Motorstorm for example, or some BMX game). A strike occurs when there's a takedown request put in (via DMCA normally, or if video is stolen from elsewhere that does not meet fair use guidelines). If multiple videos are listed in said takedown request it only counts as 1 strike. If multiple requests are filed, then it counts as 1 per request. I can't say what happened as I have never actually seen the content from that user but I have a specific contact that may be able to speak to someone that can help (this is absolutely normal by the way. The power people have in youtube is really dumb because you have to know people in the ranks to be able to do anything).
Yeah it was quite alot of Nintendo stuff, but there was no monetization at all from it and the channel wasn't that big, so I honestly don't know if Nintendo took action themselves or if it was a report. It doesn't seem like a report though because there were no strikes or warnings so idk. Anyways thank you so much for the info and help, means quite alot.
He should definitely be getting a reply if going through YouTube support, he needs to explain to them what context the videos were and how he believes they were made and fell under Fair Use guidelines. Plus the no warning of termination is not good and they're not abiding by what they're preaching. It might be a long process but he will need to keep a ticket with them open and going. I just dealt with a few Community Guidelines strikes and it took YouTube four times to review one of the strikes until they determined (with persistence and me providing more context) that the videos were deemed okay within their guidelines. That includes the original flag, the appeal I filed, the escalation I asked them to put in to their legal team, and the second inquiry that when through when I asked them a bit more about it.
From what he's said to me it seems like he's only sent in an appeal once. I'll tell him to be persistent. I also don't know what he said in his appeal so I'll have to ask him about it, maybe it wasn't sufficient enough and maybe YT just disregarded it. Again I don't know. I'll ask him and update the thread with details as I go along. Right now I'm going to take a break from all of this but thank you for the advice. Hopefully this thing is going to get worked out and I'll do some more tomorrow. I genuinely enjoyed the content of Bronze's channel and it sucks it was taken down due to Youtube's corrupt and flawed strike system. If anyone else has advice, feel free to post or PM either of us.

I still have access to my email, and google+ so I was able to do the appeal. I still haven't gotten a response for about 18 hours.
So after further investigation, it turns out that his YT account is COMPLETELY terminated. Without warning. No strikes, emails, nothing. Zip. Really sucks when such a big company as Youtube can't grasp Fair Use and Copyright at all. Yeah, it's total bullshit, right? All of these channels that have been taken down because of the fucked up system. Just a click of the report button and you're out for good. That's what happens when you put users in charge. ESM really was a great channel, and the work that was put in to bring unknown information to us was alot. I honest-to-God can't express my anger with Youtube in situations like these. Sorry guys. Thank you so much for the people who would give up what they were doing even for a second to help him out when it was needed.
