    This differs from any other company on the planet how?

    Looks like the important part is "had not done enough." It's not reasonable to assume that eBay should do nothing about fake Sellers, and it's not reasonable to assume that they can police every listing. But it is reasonable to assume that there should be a mechanism in place to at least try to prevent Sellers from passing fake items, and I'm guessing that's the area they failed on.

    I had a monthly reporting stint once over DVD copies of Song of the South and the modded Panasonic Q systems. I reported probably 100 different sellers for selling copied or modded goods...and of the dozen or so I checked a week later they were still online selling. That was the first and last time I ever bothered reporting Sellers to eBay...heh. I learned that eBay policing amounted to nothing more than lip service and that's probably what was proven in court. Having a policy is one thing, but having a completely ineffective policy is the same as doing nothing.
