Basically, it all started when my old 360 broke down right before GTAIV came out. I decided that it would be a good idea to buy one off of ebay, and bought one from a seller with good feedback. Bought it on the 13th, and paid on the 23rd (I let the seller know in advance that I was going to pay late). Now, here is where the issues start popping up. April 23-April 30th: I was told she would send it out with tracking, get no reply or anything. Send her several emails asking what happened with it, and I get nothing. May 1-May 5: Then I get a email saying she has had "family issues" and has been out of town, and that she would send it out first thing with tracking. Still nothing. May 6-May 8: I send her more emails, and finally threaten to take this to paypal. She says it will be sent out, and gives me a email on the 8th with tracking. At the time, it does not work (Which is typical for the USPS). May 9-May 13: The tracking still does not work (It does not take this long, usually a day), and I send her two emails asking if she can check it and correct it. I have not heard anything back yet. Then I find that she has gotten 3 negatives and one neutral since the last time I checked. Basically, at this point, I am not sure what to do. On one hand, I want to wait until Friday until I take anything to paypal, since there is still a chance it might just be a mistyped code and that it might come before then. On the other hand, I am getting really skeptical, and want to open a paypal complaint for security at least by tomorrow afternoon if I don't hear anything back or get anything. Funny thing is, she was supposed to refund the shipping, but has not even done that. So far, I have no proof she has sent it out, and the red flags are going up. And, quite frankly, I can't waste $200 because of a bad seller (That is basically one paycheck for me).
Just open a dispute with PayPal. The process will most likely go on for a while in which the item has time to get delivered.
I would of been claiming along time ago. Once i waited like you paypal sided with me and then there werent funds in the guys account to pay me back!
Notify paypal. In the process they will have to show it was shipped or you will get your money back. On refunds expect it to take a few months.
Figures...Anywho, I guess what I will do is wait until the mail comes at 2:30 and see if it comes, and then if it doesn't, send a email to her telling her that I am going to paypal and open a dispute. I have a bad feeling about this, since she mentioned she was on disability (Granted, that might have been a ploy for me to pay faster), so I get this weird feeling I might not get my money back if it does not come.
When I pay late, sometimes I do because I get on school when the bank opens and I get out when the bank closes, geez, I don't care for the seller if he or she doesnt ship in the same time I have made him wait (ie, I wait 1 week, the seller may ship in 1 week, its fair). If he doesnt ship then after 3 bussiness days, I ask him or her. If I get a serious response, I do accept usually. If I don't get a response, I do open an alert on eBay (aviso), but I never had to put negative feedback or something since usually all sellers I've dealt with are fine (execept one who sold me a boxed MD + game set, got the games but didn't get the MD, just the pad and the AC adaptor, ), so no problems. Too, I see sometimes that some sellers are total dicks and should get out of eBay. I know people who bid on something which had to be payed in three days, payed on the fourth one and got negative feedback, and the item went to the second bidder. Once I did win something, but then for several causes I couldn't pay it. So, I asked him for how much did the auction cost to post, and since I was the only bidder, he gave me neutral feedback and posted the auction back. And of course I never buy from auctions which look too much... Automatic. Sometimes, you get better results with auctions which are just a paragraph of badly written text and a pale photo than some of those auctions filled with cool letterings and things... Casual users usually are more responsive and personal, and best of things, more sincere. I only buy to JP and UK users anyway.
Yeah it sounds like crap, so open up the paypal dispute. She can still fuck you over by sending a box full of rocks or something and then showing the reciept, however it sounds like she is just ignoring you altogether. There is the possibility that she really is disabled, bedridden, etc. and just can't get to the post office. However that's not your problem (cruel as it sounds.) I'm sure you'd send her the money if the console were to magically show up.
A word of warning, the sooner you take it to Paypal, the better. I'd start a dispute up now, theres nothing lost by not doing so.
Small update: Didn't get the item today. When I went to file a complaint, paypal gave me the following message: So, I was forced to escalate it up to a full claim, which the seller has 10 days to respond or it will be ruled in my favor.
stupid people I hope you get your money back. My 360 just recently died and picked upa used one from gamestop.
Words of wisdom, I've only lost money on eBay once, and it was just because I waited too much to fill the claim. At least it was a small amount. You did the right thing filling the full claim. If the 360 finally arrives you can always notify Paypal and retire the claim.
Just do it. You have given her enough time to organize herself and it is now down to her to either send it or return your money. You have been very reasonable.

yea just take it to paypal, no mercy. if someone if going to sell something on ebay, they should be held responsible. gl on getting ur money back or the 360

When creating a PayPal account it has to be linked to a credit card so I would imagine it'd just get charged to that.
You should always be very careful when spending a large amount of money on ebay or something like it. Also, I don't understand why you would buy a Xbox 360 on ebay considering the poor quality of the machines. The only people I know that buy Xbox 360s on ebay do so to buy cheap broken 360s that they then swap and return to a store to basically steal a brand new unit with a switcheroo. Anyway, definitely don't go buying any more 360s on ebay. I'm sure you were just trying to save alittle money, but you were better off buying a brand new arcade 360. I had to do a Paypal dispute against someone that I bought an expensive DVD boxset from. They never seemed to respond and there was no sign of the item and I opened a dispute, then escalated it when they still didn't respond. Then one day I just happened to check the Paypal account and saw with no fanfare my money all refunded. I don't know if the person refunded it or Paypal refunded or whatever. But the key certainly is not to wait around. If someone doesn't respond you need to take defensive actions.
I'm not so sure tbh. If she has no funds in paypal you could be screwed. I'm sorry to say but the web is full of stories of paypal finding in the buyers favour, but the buyer getting jack shit money back. Paypal's protection sounds great when you see it advertised on auctions. In reality its useless. Did you pay by credit card through paypal? If so contact them and they'll sort it. They might not get the cash back from the bitch, but they'll give you your money back. Golden rule - ALWAYS use a credit card with paypal. Credit cards have proper protection, very stringent laws, and they don't suffer shit well. Edit - the above is re posts 16 and 17!
EDIT: I guess I spoke too soon. Not 5 minutes after I typed up everything, I look in my email and find that she refunded it. Well, I guess i'm off to gamestop to pick up a 360!
