Game Action Replay Data Error

I recently bought a QJ Game Action Replay for the NES (not the Datel thing). Unfortunately I have a problem with the restore function in the main menu. The restore works fine when the unit is powered on, but when I try to restore a gamesave after the unit has been powered off for a while the GAR tells me 'Data Error'.

Could my unit be damaged or is it just a problem with the onboard battery?
