She brings the game to me to stamp my receipt. . . games infront of me in her hands. I asked for another copy she said nah we dont have anymore till monday... So o said "err ok i guess u dont want to sell it to me cos u broke release date..." TURNS AROUND WITH MY GAME AND THEN GETS MANAGER!!!! So no game and forced to take refund. And i mean they forced me! As in give me your credit card for a refund because your not getting the game.

forcing you to be refunded seems very stupid from a retail standpoint, a simple "i`m afraid we can`t actually sell you this until monday" or whatever would have sufficed.

I don't know about UK law but here street dates are contractual between the retailer and distributor and has baring on customers. If a company fucks up then that is there problem. Furthermore once sold they can bitch, moan, and threaten all they want but it is all baseless. They have no right to force a refund on property they no longer own. You didn't consent to the refund so they basically stole your property from you.
Yep. I was for a second thinking of wasting police time on it but i thought its abit over the top. Took my refund and sent a complaint to head office. Which i will be following up on.
well.. since they did break the street date in more than one occasion, i guess you could say they discriminated because "i is black/foreign/gay" or something that sounds seriously discriminatory
Yeah but is forcing me to take a refund after the fact ive seen the game and was just waiting for them to hand it to me actually breaking any laws? Im ready to call up their parent company and make a complaint in the hope they make the store sell it to me. However i would prefer to know if they broke some law.
Yes, i guess it is a form of breach of contract. You had agreed to a price, you paid for it already (although arguable not cash, which means that the order was not complete until the money was transferred in the following days, they could argue). However, having done "your part" of the contract, they didn't do theirs. They changed their mind at the last moment and forced you to get a refund. This is very far-fetched, but if you were to go to court they d order specific performance. But that's a moot point, considering that the release date will be due much sooner than you can get to court Answering your question however, yes they did break a term of your oral agreement as evidenced through your and their actions. Umm second call to them... on a free number They are sending me a £10 cheque. Not a voucher but a cheque... She did say they normally send vouchers but as this was a unusual problem she sent me something i can spend anywhere.
Yeah they have been sold and this has resulted in it being leaked on to the net before the release and the ending getting leaked and even more. To be honest I'm quite mad about it all considering that I and many others have been waiting for this game for ages and now people are playing it illegally. It really sucks
