Legal help (again!)

    Ill try and explain this as best as possible........

    Me, black-out drunk in the back of my car, my best friend, driving.
    He swaps out to let a 15 year old drive my car. Crashes into library lawn, axle fucked, front right tire and rim... fucked. entire right side of car with mirrior, 1 inch dent scrape completely fucked. car towed and impounded, no damage to the library (thankfully)

    Cops come, the drunk girl, who was driving arrested. I just got dropped of home by the cops they took my license and i'm getting charged with having an unlicensed driver drive my car.

    Can i sue her?
    Can she sue me?
    How big is this ticket?

    and i know im an idiot, please dont

    and helpfull ideas on anything please
    i might have to sell all my xbox dev shit

    Did you consent to letting her drive? If not, then surely there's no case. That'd basically be grand theft auto.
    If you were wasted... I doubt they can say you were of sound mind if they try and pull a "we asked him, he said yes" (when in reality you were like "aflskdfjslkj")

    cops just dropped the ticket off, i googled the results

    Accepted Answer

    N.J. Stat. § 39:3-37.1 entitled "Unlawful loan of license, vehicle; penalty" says the following:

    a. A person who has been issued a driver's license shall not lend that driver's license for use by another person.

    b. A person who owns, leases or otherwise has control or custody of a motor vehicle registered under the provisions of this title shall not allow that motor vehicle to be operated by an unlicensed driver.

    c. The penalty for a violation of this section shall be a fine of not less than $ 200 or more than $ 500, imprisonment for not more than 15 days, or both.
    You will likely be assessed the minimum fine and no jail time will be given.

    So, plead not guilty
    say i was under the influence and didn't give consent in sound mind?
    I can get my friends to testify on my behalf.

    Either do that, or bite the $200 (assuming you're lucky and get the minimum). If you decide to fight, you'll also want to fight for your personal damages.

    Insurance goes by the vehicle owner

    You can go after your "friend" in civil court for damages as he was supposed to be bringing you home.

    I know a good nj lawyer who can get you off any major charges
    but it will cost you $6000 or so.

    5. Profit.

    Just tell the court you didn't consent to the "swapped driver" don't even say you agreed to let her drive.

    You yourself are partly to blame for getting drunk when you had a car with you. Just pay the fine and chalk it down to a lesson learned.

    If you get off with the fine, then at the least your friend or the girl who crashed your car should reimburse you for it.
