Heya. Thought I spring this sort of topic on, based off a recent purchase.
I bought Kirby Super Star Ultra new and everything seems legit. Have not opened yet though.
The wrapping is unusual. Not sure if cause of the age of the game, but know how the tear line is on the side where the case is opened normally on newer released DS and 3DS games? Yeah, that is on the spine.
The hollow where it is opened also has a scratch or something, though I guess it could be a factory defect.
    Check the images.
It has been a long time since purchasing any games that old. Compared with other DS games still wrapped that I had not got around to yet. This wrapping is tight and clean, as many Nintendo brand games are. Is it possible that the wrapping was a mistake at the factory or did I buy a rewrapped game?

Looks re-wrapped to me, it wouldn't have folded over edges like that. But if you're going to open it I guess it doesn't matter. Is the game from Japan? Because that would explain it, almost everything I buy here is re-wrapped or re-shrinkwrapped.

It's quite odd, some games will have a tear strip around them, others won't. Depends on the publisher also.
I've had Pokemon Omega Ruby from launch night in a plain wrap like the one in OP's photos.

I can confirm it depends on the publisher. I've had multiple versions of some particular game (US) version, and they were wrapped the same way.

Publisher is Nintendo. The game is Kirby Super Star Ultra (Nintendo DS). It is a North American version (they do the V-fold on new games, so it is not odd in that case). The game case itself seems legit. It is just that the plastic pull which is normally on the side of the case where you open is strangly on the spine instead. Every DS game I have bought new from store has always had the plastic at the door/right side. I compared to the DS games I have yet to get around to and are still sealed. None of those games have the plastic in the same manner.
The hollow picture is on the right where your pull and open case. There is a scratch/damage there? which I have only seen once on a Capcom game. The back of the case also has a scratch on the cover under the plastic, as seen in the added picture on this post (poyo 2). Whether it is factory error or not is hard to know (as I am unsure if this happens....).
Ultimately it matters in the sense I payed new, not used. They discontinued in North America (at least US). If it is a rewrap, I want to have used price unless it is proven otherwise. That and I have awful luck buying used games online..... so go for new normally.

Extra: The tear strip...? I do not know if you mean those placed around the center of the game, but I have not seen those on any video game release in North America. The pull tab, I guess you call it, is only on one side as normal, but on the wrong side. Cellophane appears to be legit though (but what I know...?).
