    Im seriously crying a bit, i dunno why but this idea makes me sad. refund or whatever ebay stuff you can do.

    Problem is now I have to spend $13 of my own money to return this stuff.

    So I will be -$13 in the end.

    here is a little hint for you, dont do this ^:

    #1 - its illegal
    #2 - its immoral
    #3 - he has already stated on a public forum that he has received the items (regardless of if he was happy with the condition) so it wouldnt be hard to prove that he was trying to commit fraud

    if he has already admitted receiving the games then trying to claim that you "never received" them is illegal

    hardly worth getting into trouble for $13, if you are that skint you should not be buying video games in the first place ;)

    I bet that the seller never had them sealed in the first place.

    I can't see it happening. If it was really a "clueless" person like you said, then maybe the fault is yours.

    I don'r know, but I always say the word "sealed" when I buy anything sealed. Like "hey, I made the deposit for the sealed bla bla bla", "hello, I've bought the sealed thing, please calculate shipping..." or even before "is it really factory sealed? if it's not sealed, then I'll send it back" and things like this...

    But if it really happened, the first thing I would do is "hello, why you sent an opened item if it was "sealed" in the description, are you crazy? Are you kidding? Of course I will send it back, AND I want an explanation. Are you crazy? How old are you? Do you know that I bought because the "sealed" thing? Not because it is blue, but because it is SEALED... Do you have another sealed copy? Because I will not stay with this opened one. This is useless to me."

    Of course I know that eBay is so automated that maybe something like that can happen. I really don't like this auto checkout thing that eBay have. People don't even talk. An talking is important when you want a sealed thing.

    So, sen it back and don't worry! Another copy will eventually appear.

    Can't you claim for return shipping where you can prove the issue is the seller's fault?

    That's a pretty lousy thing to do. Did he make any mention in his auction listings that he'd do that?

    This thread needs a before and after shot - photo from the auction and photo how it arrived ;)

    What was the sellers feedback score? Does he have alot of past transactions? Im going with they were never sealed in the first place.

    Even if the seller was just bitter because of a low ending price, that doesn't give them any right to open a sealed game that someone bought, the games were listed as sealed and ASSEMbler did not get what he paid for, by opening a sealed game after someone has already paid is in part not honoring your end of an auction, I think a serious chargeback and negative feedback is in order ASSEMbler.

    If it was the low price issue, wouldn't the seller have taken loose games of the same titles and kept the sealed game for another day?

    Any chance you can finger the offending seller so we can avoid him?
