Eh, caveat emptor is the way of capitalism. It's like natural selection. I bet the winner, moronic as he or she may be, will never bid without reading the entire listing ever again. People and corporations put intentionally deceptive language into contracts all the time, it's not criminal, it's just contract law. Ebay isn't any different, it's just not regulated as tightly. I'm not saying that I'd feel comfortable making an auction like this (I'd probably fold and give the poor person their money back, minus my listing fee), but I'm not going to go rail on the person who did make it up.
Oh well, the seller won't get away with it. The title says Nintendo DS, nothing about a picture. It is listed under video game consoles, not crappy pictures. It states the contents sold with a Nintendo DS, not a picture. It also states he takes full responsibility. If I got a picture from him, I'd report him to eBay. And eBay WOULD take my side. p.s. this belongs in off topic not marketplace.
I think it was just a poor use of words/ discription , but I worry about people who will not take paypal.
He probably was really selling a DS, but man, what a poor choice of words. I hate seeing confusing auctions like that one. When in doubt, take your finger off the trigger.
I would believe they were selling the real deal but I have to agree I would never bid on teh auction since it would leave me open to being scammed.
