Was in an EB Games last week and almost lost it. they're selling copies of the NOT FOR RESALE Zelda GC titles in excess of $40. How the hell can they do this. Is there any way I can report something like this?

I know I know it could be worse, but this just annoys the hell out of me.

"Not for resale" is not a legal term. Rather, it is a contractual term. In other words, there are no legal penalties and it is perfectly legal to resell a NFR product. However, if a company or individual has a contractual obligation to the company producing the NFR item, then resale of that item could be a breach of contract.

Of course, in EB's case they DO have a contract with Nintendo, either directly or through their distributor. Good luck getting Nintendo to give a crap about it though.

I also like how they sell RE2 and RE3 for an exorbent price on GCN. Even though a re-release has pushed the resale value well below 10$ now.

Other than that though, I really dont like the company anyway. The games they stock arent interesting, they treat the new PC section like a used one. Tattered boxes, un-interesting games.. The organization in our EB Games is awful. I couldnt find a game I wanted without spending an hour looking.

Honestly I use to like eb games before they were owned by gamestop. After gamestop took over most of their good deals went away.

But both companies tend to treat new pc games like a used section.

I cracked up when gamestop by my house was selling the collectors edition of half life 2 for $50 brand new when all the other places were still selling the regular edition for $60.

The one thing I hate that eb always does is selling games that are used as new.

My favorite part is when they get mad at you (a paying customer) for catching them. I really want to throw a brick at that guy's head...

I have plenty of hate for EBGames.

Honestly if you did that they would get the message. Places like that have huge diffcutly dealing with any type of hostile behavior.

I remember before funco land got bought out by gamestop I reserved the 2nd season of the simpons there and paid it off before it came out.

I go that day it arrives to pick it up and the manager is like blah blah that will be 34 something. And i was like wait i fully paid for that.

And he tries to argue it.I debate with him calmly with no hostility at al.

So I finally tell him maybe i probably shouldnt pre order anymore and was about to leave, and he freaked out big time and was so nervours and was like "its fine its fine its our mistake, your a usual customer i trust you."

Well it turned out the one time I went to go pay for the pre order for that and mario sunshine, the idiot working there put the money I payed towards the dvd set to my mario sunshine reserve by accident.

I didnt figure this out till I went to acutally go pay for sunshine and was stunend to find it was mostly payed off.

That manager was happy cause the fiasco was settled and he could fix it for corprate. Now he runs other gamestops and is a huge douchebag(pardon the languge if it offends other members).

The point is unless you have no other choice, I would say dont go there anymore, even though their behavior some times isn't right.

Excuse me, sir; I am highly offended by your usage of the term "douche bag". The correct terminology is, "douchebag".

Seriously, though, EB Games and Gamestop rip you off in insane ways. They pay you like $10 for almost any game you bring in, yet the other day I saw Rez, used, for $40. How the hell can they charge $40 for an old, used PS2 game? Idiots. And I see people coming in there all the time to sell stuff for pennies.

Lol, sorry la-li-lu-le-lo I have corrected it. The reason they rip you off is simple, they go by the wholsale price then lower it cause the merchandise is used.

I cleared out like 30 god awful games I had sitting around that I bought from yard sales, received and such that I couldn't sell and traded them to GaymeStop for like 40 bucks and bought RE DS. The problem is that at the time it was Febuary, and they wouldn't take the DC web browser or Ready 2 Rumble Boxing, so I asked if any of them wanted them because I don't. The dude just kind of looked to the side and was like I can throw them away for you. He said the same about the Pokemon game with the box! I was like WTF and gave them to people that were shopping there that wanted them lol.

I miss when EB was just Electronics Boutique, and I miss buying there cheap PS games they had sitting around sometimes. Some were pretty good games.

I only have a GameStop near me, and ever since the whole corporate restructuring after they purchased EB (and the cool manager left shortly thereafter) the place has gone completely downhill.

Fortunately, unless I can't get it anywhere else locally and am too impatient to order it, I don't have to even bother looking in GS's general direction for getting stuff...I'll just use my 10% discount at Wal-Mart (even good on their website).

The real issue I have with them is that they buy up independent shops in the local area and then screw everyone on prices and selection.

If only there was a gamestation in the USA.

They can only sell that NFR game if it is used, not if it is brand new. LIke if they were to open up the box of zelda games and took out all the bonus discs (unopened) and put htem up for sale rather than keep them for those who reserved copies is a violation of that contract between them and Nintendo.

What do you expect? Trade-in is always a fair bit lower, they will sell it less than 60 and they want a cut of profit.

Just sell on ebay. Best way.

Perhaps because games like Rez are in demand?

Just because it's old doesn't mean nobody wants it.

Hell, Sapphire is old and used. Why can't I buy it off someone for $10?

Same exact thing happened to me.

I'm never preordering and fully paying for a game all at once there ever again.

The local EBgames near me sells copies of NFR Zelda disc's and had several copies of The Guy Game, which last time i looked, wasnt suposed to be available for sale.....

EB games here in canada, had a game of the day deal back in early june, where each day, there was 2 failry new titles for 9.98. Of all the Ebgames i visted, and i visted 8 that day, only 1 of them would acknowledge that the sale exsisted. All the others looked at me stupidly as i argued with them. And don't get me started on how many times EBgames have changed the price of the game, from what it is on the price sticker...grrr

It's called "doctrine of first sale." Just because it says "NFR" on the front doesn't mean someone can't sell it. Hell, most of the items sold on Assembler are NFR but no one complains. Why is it OK for an individual to resell a NFR item but not a corporation?

As for prices, if it's on the sticker and it's clearly not a mistake they have to honor the sticker price if they are in the US.

Well, like I said in another thread, the clerk at GS gave me a NFR Advance Wars DS out of the tons of non NFR ones, which is wierd how it ended up in that pile, but as long as it's the full game cool beans. Kinda cool too.

It would be nice if the NFR Zeldas werent priced really big at the Gs's though. They get them from trade ins I think, I don't think they just ripped them out of the boxes or whatever, but it is wierd how a demo kiosk game got in a pile in my case lol.

I know what you're saying, but I really don't think Rez in very high demand. I don't think there are any used PS2 games (US versions, anyway) that are in very high demand. It seems like it takes almost a whole generation for used games to become very valuable.
