ebay auction cancellation question (but mostly venting)

Q: I recently won something on ebay & paid for it immediately afterwards. A couple of days later the seller refunds me & sends a note saying the item had sold locally 2 days before auction end & that they forgot to cancel the auction. Yeah, the price would have been pretty darn good if it had gone though, so I suspect they simply decided not to sell. Now, as I understood things, sellers could only kill an auction before it ends & then only if it's at least 12 hours before its due to end - not a couple of days afterwards?

I know a complaint would be pointless & if the guy doesn't want to sell there ain't much I can do about it, but it does annoy me that (a) the ebay bid is a contract thing only seems to apply in 1 direction and that (b) my ebay status page now insists on telling me that I need to pay for the damn thing again! And I'm feeling cantankerous today, anyway.

    The demo UMDs are real.

All the eBay auctions are fake.

Very few people actually have said discs in hand at this point.

Those selling know that the demo is anticipated so they're trying to cash in on it. Of course, without having the disc in hand you can't actually take a photo of it to post up. ;)

If you completed the transaction report the seller for violating eBay rules regarding selling items they do not have, file for a refund with eBay and PayPal and leave the guy negative feedback.

That'll learn em for trying to scam you.

You said you were out a couple of dollars on paypal fees - you should get that refunded as well, I'd have thought.

So, the seller contacted ebay to initiate a transaction dispute on an item that they didn't have to sell? Also, I didn't know you could mutually agree not to complete the transaction? Does ebay still get their fees in such a case?

    Hey limey

You're right, there's nothing you can really do about getting the game, but you can leave him negative feedback. eBay does have rules about having the item in hand and it used to be that the Seller must say he doesn't have it and he must be able to get it in a certain time frame, maybe 2 weeks? The Seller probably is telling the truth since there's no rational reason he'd list something he can't sell.

If a Seller offers you a refund it should always include the amount you paid. He's shouldn't be subtracting Paypal fees. He pays a fee because the money is transferred. He accepted that fee when he accepted using Paypal. It's his fee, not yours. There are always going to be exceptions to the rule, like is a Buyer sends the wrong amount, but by and large unless special factors are present he should be eating those fees.

Side note....message boards should have a button which allows you to create a reply that actually opens up an entirely new thread. I don't want to hijack the thread, but some people might want more info on eBay.

I rather suspect the final price it went for was somewhat lower than the seller anticipated, but yes - it could really have been sold - no way to know for certain (unless it gets listed again!). I got a full refund & the seller's been fairly contrite, so I'm not going to go off the handle. And the trouble with leaving a neg, is that 99% of time, you'll just get one back - that whole system is highly flawed.

Agree fully, unless the refund is caused by the buyer wanting to back out, or something. Then the buyer should eat the fees.

The thread title says ebay discussions, so I think this is fair game. That would be a useful feature in other situations, though.
