Recently I won the auction of a PC game on eBay. The description said the item was still new, so unused. After 4 weeks I received the game (at last). Which was shipped from the UK, so normally doesn't take that long. But that was not the real problem. After opening up the package it didn't take long until I realised it wasn't new at all. The disc contained some serious scratches and the outside of the manual was somewhat crumpled up. If something is second hand, don't say it's new, that's lying. (Maybe I was too naive, because the seller said in the auction that he had to open up the game in order to make some scans.) So, I emailed him to say that I was dissatisfied with the condition of the item, and asked for a refund or some other solution. He said that when he shipped the item it was still "BRAND NEW" (exact words by the way). I doubt that. He refuses to give me a refund because "i shouldnt have to because i can say that my other buyers were 100% happy with there games and if it had been used i would have said as i am not that type of person. If you want a refund you will have to take it up with eBay." I think that these things regular happen on eBay. But what's the best thing you can do? Is reporting such cases to eBay useful? And what about negative feedback, he maybe gives me negative feedback (in revenge) too. P.S. it it possible such damage is done during shipping??
Nope -- you got fucked. Negative Feedback is basically all you can do. And yes, he can negative feedback you as well. Doesn't sound like he'll be giving you any feedback until you do first. How much is yours? How much is his? How much was the game? Just give him a negative feedback, and if he gives you one that contains any false information, bitch to Ebay and say that it's slanderous. Someone won an auction of mine, and 5 minutes later I had a negative feedback saying, "trying to sell PSX CDRs". Ebay tried to give me, "we can't do anyhting about it" bullshit. I promptly emailed back, told them that not only were CDRs illegal to sell (and I had not done any) that the statement was slanderous, and they were a party to it. The deleted the negative feedback then.
I have 21 feedback and 100% positive, he 29 and 100% positive also I'm first gonna mail him one more time, if there's still no solution after that, I think I give him negative feedback. That would be the first time I give someone negative feedback, but I believe he's deserving it, besides I have nothing to do with his previous buyers who were sattisfied (that's the past after all).
I hate fuckers like this. I was scammed by two ebay sellers recently - one of whom was Raven games London - who sold items as 'new' but were in shit used ass condition. These self-righteous fucks always resort to the typical bullshit they gave you - 'OMG I HAVE 100% FEEDBACK EVERYONE ELSE IS TEH HAPPY HAPPY CUSTOMER *YOU* ARE THE ONE THAT HAS TEH ISSUES'. Sellers like this should be shot. In the head. No, the balls. Five times.
Sounds similar to the Genesis I just bought off of Ebay. It said it came with the box and it was in OK condition and when I got it it looked like it had kicked around and the bottom was all tapped up. My mom picked it up from the guy on her lunch break so it couldn't have been damaged by shipping. Anyways the moral of the story is always double check what you are getting. Ask for some more pictures if necessary and get them to describe any damage before you buy.

sometimes , ebay can be a bith.... but other times , it can be heaven.. :smt083 just do this : never trust anyone. (on ebay , sure! :-D )
I have been in your situation once before - bought a DDR 7th Mix arcade CD from a guy, only to have a CD-R arrive with "7th Mix" scrawled on it in marker. I got a hold of him saying I thought this was the original, and it stated nowhere in the auction that I was getting an illegal bootleg, and he said he thought I wanted a backup (WTF?) and he'd give me a refund. I never saw one and all subsequent e-mails from him were ignored, so I left him negative feedback about selling a copied item and not refunding. Not 4 hours later he left a largely uncomprehensible e-mail about me being some sort of "dishonets buyer" which I think is like dishonest, but I'm not sure. I was so pissed that the fucker ruined my perfect feedback with his little revenge. There is one thing you can do, however, and that is leave a comment on your feedback that is visible to all people that check - say something along the lines of "Revenge feedback left when product was not as advertised and no refund given" or something explaining that you really aren't deserving of it. Depending on what he leaves, you can then follow Kyuusaku's example and get eBay to nix it from your record.

You can actually get him banned form ebay for that GSL and then his feedback would be nullified.You can also report him to the US Federation against copyright theft for selling pirated goods.Not sure if it's called that still, the euro equivalent is elspa.You will find their ame from Nintendo of america or SCEA.I would rport him GSL to stop this kind of blatant piracy selling mate, this is what puts punlishers and dev houses out of business.
frankly I don't give a h**t about the feedback much... and certainly not mine. I don't really care if someone left negative feedback coz I can return the favour... I've been hit with some dodgy seller/buyers in my time on eBay. still life goes on and I've learnt my lesson... I sometimes wonder why every one's so uptight about the feedback... cheers
Well, I would have tried something like that, but as I was buying a CD from an arcade machine (and a machine that isn't licensed for use in the US, I might add) I'm not sure how much help the bigwigs would have given me. Besides, it was a $12 cd and this happened over a year ago, so the auction link has been long taken down. And the feedback, dj898, is sometimes the difference between someone bidding on your item and not bidding. I'd rather bid on an item from someone with 100% good feedback and 200+ transactions than someone with 75% feedback and 1000 or so transactions - the higher feedback a seller has, the more reassured I am that I most likely (although it can happen) won't get screwed over, especially if I'm bidding on something costly.
that's true mate. still if the seller has more than 95% of positive feedback and especially no negative feedback in last year or so I'm happy with that... and maybe it's got something to do with the fact I don't buy off eBay if the item cost me more than $30... cheers
Ah i remember this happened to me for an auction for dead or alive for saturn, i win the auction and send the money order. For a week i dont hear anything from him. I keep e-mailing the seller asking if they had recieved payment yet(it shouldnt take that long since shipping here within the U.S. is always a 3 -4 day average, anyway the seller does not respond, after two weeks i ask him what is up again and if i dont get a reply i will post negative feedbac, jerkoff responds as will I.Even though im furious reading this, i decide to ask him again politely if he had recieved payment or not(reason i didnt want to get negative feedback from him was it was my first auction so i didnt want to start by having a negative feedback). Any way 3 days later after sending the e-mail i recieve a package from the seller in one of those postage baggies with bubble wrap. I open it up to discover that its not dead or alive, but 3 saturn import games i didn't order. However one of them was METAL SLUG!!!!!!!!!!!!! The manual was a little torn in the back, and the cd had one or two small deep scratches yet played perfectly fine, but other then that it was in good condition. The other two import games were capcom generation 3(which i recently sold to greatsaintlouis) and marvel super heroes. So since the inconvience i put up with(and the fact that metal slug goes for such ridiculess pricess, I decided not to say anything and keep the games for such horrible service, whats funny is the amount i paid for dead or alive with shipping, yet got these games instead.....................can you say $10!!!!!!!!!!!!!!!!!!!!!!! Man i dont think I'll ever get a deal like that again.
well I once bought PC Engine suitcase interface from UK seller. Now this seller isn't familiar with PC Engine stuff - said he fond most of these from flea market and himself never played with PC Engine... anyway when I received the item after two weeks he not only throw in the all the cables, AC adaptor and etc for the interface but complete CoreGrafx, CD-ROM2 module, AND SUPERGRAFX!!! And I got the e-mail from the seller saying that since he bought those extra bits with the interface he throw in as freebie... So for the PC Engine interface I got complete PC Engine plus SuperGrafx... Even after ridiculous shipping charge from UK it was best deal I've ever had on eBay... I sold suitcase interface inc. CoreGrafx and CD-ROM2 and got myself SuperCD-ROM module to go with my SuperGrafx... cheers
I once got a free PlayStation thrown in with a mint Saturn MK1 I won for around $35. The guy said he was going to donate it anyway, though he may as well gave it to me. Even convered the extra shipping. I was amazed.

Hey Jeul, if you want to be sneaky you can just wait a while on leaving the feedback, about 89 days. Leave negative feedback then and if he doesn't notice on the 90th day it'll be too late for him to post neg. feedback in revenge. At least I think you have a 90 day window to leave feedback (the same amount of time the item is up after it's sold) but I'm not sure. Leave it like an hour before they take the listing down, teach his ass a lesson.
