Ebay Seller cancelled Auction 2hours after aucton ended , What next for me?.

    I just won a famicom mini set 1 and 2 brand new for less than 50euros on ebay only thing is the seller said he had sold it to another party before the auction ended but could not log on to ebay to cancel the auction. I am wondering what happens next? ebay asked me if i would accept his cancellation or decline so i declined as i taught it was very unfair. Am i wrong to decline? and what happens next?.

    If you decline, he will be out 10% fee to ebay on the finishing price. However, he could open an unpaid dispute on you too (but its against his interest, as he would have nothing to ship).

    Basically, not a lot will happen - you can leave him negative feedback. There isnt much he can do about it all really. Hes already violated ebays t&c's by selling it elsewhere.

    It basically boils down to have vindictive you want to be. You wont get the item either way, but you can cause him a 10% fee or you can agree to the cancellation.

    Just got a ebay PM from the seller he is now saying it was damaged and this was his words


    Dear wynni72,

    Hi, to be honest it's not sold. It's been damaged and I can't ship it as is. It's no longer as described. I want to sort this as its not fair on you.

    How would you respond to this?

    He is just trying to make you agree to cancel so he doesnt have to pay the ebay fee.

    Do Ebay get involved or is that it, can i just cancell an auction after it ends if i dont get the money i was after in the first place?.
    I know im not getting the item, i kinda new from the start this or something similar was going to happen but its not right.

    I've always been a big wuss when it comes to things like this. Technically you did not get your end of the contract fulfilled, and thus you have every right to give him/her negative feedback (or take whatever other official actions through ebay/paypal). The problem is, this -could- turn the seller into a giant asshole who will bitch and complain and do everything they can to make you look like the bad guy.

    If you're not too sad about missing the item, you can just play their game, give them positive or neutral feedback but note that you did not get the item.

    Long ago I bought a camera (Canon SLR) off eBay. Got a sweet deal on it. The seller responded shortly after the auction ended, saying his neighbor wanted the camera and he was going to sell it to him instead, because his neighbor and him don't get along and he wants to be nice to him... or something like that. I ended up caving-in after arguing with him back and forth for a while, letting him know he was legally obligated to send me the camera... and ended up just giving him a neutral feedback with an explanation of what happened. He still wasn't super pleased about that.

    He didn't get the money he wanted for the auction so he is making excuses; at the end of the day he could have safe guarded himself against this by putting a reserve price on the auction.

    I wouldn't let him get away with it, take it all the way and make him either send you the item or pay his dues and receive negative feedback!

    Side-note: I sold a signed poster on EBay about 6 weeks ago that I expected to get around £40 for. It sold for the start price of 99p! I had to man up, admit I fucked up in the way I listed it and make a loss on the item when postage cost me £1.80 more than I had bargained for.

    I just replyed to him asking for photos of the games damaged and id see if i still wanted them or not as i didnt beleive him he had them in the first place, He just replyed with this.

    Take my word for it. I won't be able to sell it again which blows. Can I do anything to make it up to you after the cock up on my side. Super mario advance 4 perhaps. It's boxed too.

    What doser that mean? another scam.

    You can get ebay involved, but they cant make him send the item. He will get a strike against his account at best.

    He could try to get ebay involved and spin them a bullshit story to get his fees back - but that doesnt really effect you.

    Just neg feedback him if you want, he cant leave anything but positive for you anyway

    Nah, he is just one of the thousands stupid ebay sellers that don't accept the basic rule: if you don't want to take the risk to see your stuff sell for dirt cheap money, you put a high starting bid, a reserve price or a BIN price.

    You've got one of the three classic stories that this kind of seller tells:
    "my cousins threw the stuff in the garbage"
    "a flood damaged the game"
    "my dog ate the box and it's too damaged".

    Funny how it's always the same bullshit that comes in the mail.

    Check this mail I received two months ago:

    "I left it on my floor where I package everything
    and there was some little flood in my apartment. It got wet and destroyed.

    I am very sorry :("

    Funniest part was of course the seller not knowing I was talking with him on an american forum (digitalpress) and miraculously, three days later, the game was again available for sale !
    Telling him that I was surprised that a miracle happened to a game I had bought on ebay and the auction was cancelled because a flood had destroyed it, what did he say ?
    That he had fortunately found another copy of the game and it was available again !
    We're talking about a dirt-rare game of course (it wouldn't be funny)

    And got the fourth bullshit ebay story coming to my mail one week later:

    "Sorry I didn't update
    you on this soon enough. Been crazy busy this month. Getting a surgery done on my leg next month so
    I've been back and forth to the hospital a lot. "

    So the question is: why evey time you win an auction at a ridiculously cheap price you get a flood destroying the game after the dude didn't answer for three weeks because he was in the hospital ? Is ebay cursed or what ? :p

    Decline cancellation notice. Negative feedback. Ignore his messages. Then forget about it.

    I asked one last time for a look at the damaged items and this is what he had to say.

    They look fine except their water damaged. Tried to see if zelda worked but no joy. I don't appreciate being called a scammer either. Apologies for my cock up but insults are not the way forward. No point taking just a nice box and no games work.



    Thats it now no more replys from me to this guy. It is what it is.

    If it was damaged, straight results in a refund. No doubt or second thoughts there. He's just trying to do ANYTHING other than a refund.

    You are missing the whole point of this thread. He has not paid or got the item. The ebay seller is trying to say the item no longer exists and cancel the auction.


    Also, water wouldnt damage a cart that much - let it dry and clean it up and it would work.
