    Mind your own buisness!! I am sure you have traded, recieved or given roms out. Under the law you are EQUALLY guilty of copyright violation.

    Damn straight he's wrong. That sounds right to you? Technically, all prototypes in one way or another violate some contract.

    OK, legalities....

    unfinished games ARE still copyrighted and ARE NOT in the public domain unless the original copyright owner has expressly stated this. When they do, they will usually say the ROMs are NOT for making money out of, selling a cart for $50 is clearly making a LOT of money out of a cheap process.

    Let the law prove what? Its up to the copyright holders to prosecute. Yes, selling the roms make prosecution more likely. However trading, recieving or giving is just as pursuable by the copyright holder. People who didn't sell have gotten screwed for giving them away. Kyuusaku, are you disputing my point? It still does not erase the fact that you have recieved, traded or given away roms. Mind your own buisness, you are just as open to prosecution as anyone else, selling, buying, trading, recieving or giving roms away. Its all or nothing these days, its best to stick together against big companies. Even if you disagree with another infrigers methods.

    Oh, and he breaks his own "law" (which is a load of crap) by stating that some games were commercially released in Japan. Released is still released, irrespective of territory, so its no good playing that card. Oh, and ROM hacking is illegal too.

    I think its wrong to pirate also. But the laws TODAY do not make distinctions between piracy and what kids do with roms for a hobby. I deal with this stuff all day, specifically concerning the use of JAVA programs in the telecomunications buisness. The consequences are the same for user or pirate. Thats why I say to just turn a blind eye. There is no need to add more fuel to the fire. Kyuusaku if you have some special insight into copyright law and its applications, please let it be known. I am speaking from exerience and not from a silly feeing of offence.

    I don't like kids+"roms" either. BTW, what 99% of kids with roms do IS illegal so I fail to see your point again. I understand the wrath of Nintendo is harsh but what am I to do? I want him to stop.

    You should educate yourself on the issues of copyright violations. They are far reaching and effect the future of everyone. I believe in a companies rights to protect thier assets, but the laws let them go much farther than that. Minding your own buisness gives the big companies less evidence to use against the little guy. A good place to start educating yourself is

    Thier site focuses specifically on music, but the application of the laws are the same in the video game world. No hard feelings, everyone is idealistic about something at some point in thier lives.

    Haha, you should see my reputation. I'm not idealistic, I'm a realist. How could piracy be fun without it being illegal? I'm pretty left wing about piracy but this specific case does hurt my feelings. I could care less about the big game corporations AND I have no cares whether or not MP3s or "roms" become PD. IMO it doesn't affect the millions of people that already do it. Piracy should be kept underground, people smug enough to sell services such as this guy deserve to be tried.

    You don't have to disreguard either of them (both are true to my mindset.) I understand what you're saying, and in the long run I'm for your cause. For now though, its much more rewarding for me to report him. I think eventually, there will be a distinction between obtaining copyrighted materials freely and publicly selling them.
     
  17. Err, I'm not sure WHAT the hell you're getting at, man. because it's pretty incoherant. You want people NOT to report this obvious ripoff pirate, yet you also want us to be informed on the issues of copyright violations. The issue here, as I see it (and correct me if I'm wrong) is that this guy is illegally selling either game roms unfit for release or unreleased in the US. Under copyright law both here and in Japan where some of those games are sold, this is ILLEGAL. Say it with me now. I L L E G A L. As in against the law, and rather unethical too. Stupid gits like this deserve to be turned in because they are making a fast buck off of someone else's hard work, be it the company that programmed the game originally or the dedicated fan who took the painstaking time to translate it into English for others to enjoy. It's like Kyuusaku said, piracy is always going to happen, and it should be kept a private thing, but the minute someone gets arrogant enough to think that they can swindle people out of their hard earned money, they have overstepped their bounds. I'm sure that many of us have indulged in MP3s, roms, or various other illegal forms of software, however, the difference between us and this person is that we don't try to cheat others, and people who do so deserve to be caught.

    You know, with as much of a fuss as you're making about this, I'd almost think you've got something going that you wouldn't want the big guys to get wind of...

    Greatsaintlouis, I'm under the impression that he's not exactly taking advantage of people, but that he's built himeself notoriety by preforming these services for the incapable. I think this because he's not very expensive (I'm more expensive :) but thanks for the backing. Like you said, my big thing with him is that he thinks he can do this out in the open and the lies, my god the lies. This guy even puts the Nintendo seal of quality on the labels!

    Being aware of the laws and protecting ones self is different from turning someone else in. I think that is pretty clear. I will be happy to elaborate on what specifics you are confused about. I have been coherent and Kyuusaku (the poster) seem to understand my postition. So Greatsaintlouis just let me know what you need
    S P E L L E D out and I will do that for you. Also, technology moves faster than the law these days. A lot of cases involve people who were just ignorant of the law. All they deserved was a slap on the wrist, but instead got the book thrown at them. And in some cases they had not broken the law, however the individual could not come up with the money for a adequate defense. This is the basis for my fuss. The punishments generally do not fit the crime and sometimes a crime is not commited, but inocence costs lots of $$$$.
    Like I said before I deal with this stuff all day at work and sometimes the person is ignorant and has made a stupid mistake. I would hate to see Greatsaintlouis as a prosecutor.

    If this case were to hypothtically go to court he would be likely be safe from the department of HOMeland security. Underground stuff is under more scrutiny than out right piracy. I'd rather deal with nintendo than that DOHS. He's just trying to make a quick buck. If you want to hear some crazy cases going on right now you should take a look. People trading roms and other things can get time behind bars, but someone like this guy would just get sued and pay a fine.
