Honestly, I REALLY hope Jim Sterling wins. Because if DH wins, it could mean some REALLY bad things for the industry.
Looking into the whole thing, I believe Sterling has nothing to worry about. The fact alone that DH is representing themselves is a shotgun blast to their knee. But I think you have a point, something like this in the hands of a competent legal department could spell disaster.
I do think he'll be fine, but if a court legally finds that Youtubers are press (for legal protection purposes) and not private individuals, that would be really good for the Youtubing community.
None of that is relevant. If he is found to have committed libel, then he should be punished (note, I don't know about this case as I don't watch him). It has nothing to do with Youtube or "gaming journalism".
The devs are accusing Sterling of 'libel' because he said, among other things, that one of their games was "THE worst game of the year"...as if that didn't fall under his own subjective opinion.
Yeah, his opinion isn't libel, but I recall seeing something about him saying that the company did something illegal. If that statement was presented as fact, but is not true (because no one on the internet makes things up for clicks/views), then that statement would be libel.
In America it's only libel if the company can prove that he purposefully lied. Which he (probably) didn't, he probably just posted something as soon as he knew about it without doing a ton of fact checking. Which basically makes him like a "real" news source.
Not really true, but besides the point. It only matters what a judge thinks. And the ideal of him being a "real" news source is, disturbing...
Actually it was the steam community that proved DH used pictures from google image search in their games without crediting anyone, Jim then mentions it and DH goes on a censoring spree which like every time before kicks in the Streisand effect, they quite up for a while then start the cycle again all while blaming Jim for everything. It also has to do with DH buying assets from the Unity store then just tossing them all together and trying to sell it as their full original work. they are one of the reasons steam is full of shovel ware Tho IDK maybe im just biased since I thank Madoka for Jim every day.
