I think they had problems with Airball where someone not only took the ROM but also used the same cover art they created. A few were even passed off on ebay as "originals". As Assembler said this can be worked around but they added an extra step to those sellers who want to deceive others.

In conclusion. You get the ROM for free, they made is harder for scammers, the game sucks anyway and I don't think what they did would affect gameplay on a game that sucks this hard anyway. This isn't Final Fantasy here. In most cases you download it and what play it for 5 mins and never look at it again.

As for the legal issue. I'm sure it isn't. If not criminal it is a civil suit if MT wanted to push it. Are you saying that this and all other unreleased games should never been dumped at all? That is the only way to stay clear of that minefield. As I said before these arguments are self defeating unless you don't want anything released.

I think with this sort of stuff theres no cut and dry opinion on it...or there shouldn't be. Everything is it's own seperate case. You can't go one field or the other all the time.

I am saying I don't think they should be dumped at all. I try to avoid that idea in my mind as I do enjoy seeing how games evolved...but...bottom line is that "reproductions" aren't exactly on solid legal ground and distributing dumped protos isn't much better. Nobody really has a right to a copy of the ROM or a "reproduction" of a cartridge.

Legal issues don't seem to come up for "reproduction" makers...but it doesn't mean they can't.

Edit: I also feel the need to give more kudos to devhackr. Hilarious image.

The best reason for rom dumps is preservation. Eventually prototype or games that there are only a few copies of will disappear into peoples collections, boxes, etc. Never to be seen again and eventually destroyed with the game lost forever. By dumping the rom we now have a digital copy of the code that will last forever. The MAME project for example started and continues to be a preservation project, to preserve the arcade machines that eventually end up in landfills.

If the true mission here is preservation then it is best to minimize any bickering over how someone donates, why they donate, how much they donate or the way they donate. The main argument here is not what is the right way to do things. The argument should be how as a community do you increase the number of releases.

Take what you can get and leave the door open so they come back and come back often. Encourage them in a positive way to do it again and again till there is nothing left. No one will see this thead and change the way they do things for the positive. Those who agree will continue business as usual but those who don't are less likely to release anything at all.

Playing it is itself illegal, so it's a moot point.
