My Selling Debacle on ASSEMbler

    First off, I would like to say how extremely sorry I am for any trouble I've caused anyone who purchased anything from me on the ASSEMbler marketplace.

    For those of you not in the know, I listed things up for sale and never delivered. This is totally inexcusable, and I deserve the bad things said about me.

    It was never my intention to scam anyone or rip anyone off. I have, as of today, refunded all the money from all the orders. I would have done it sooner, but I have been broke. Absolutely broke. The reason I sold things to begin with was to help me pay my rent. The only income I have is what I make off of my company's video sales, and for the last two months we've only brought in a little over $900 a month. Translate that to yen (I live in Japan) and that comes out to around Y70,000 or $700. Beyond that I had the prefect shit storm of things breaking, business payments being due, people dying, and a nosediving yen rate that all left me penniless.

    I should have been more communicative with those who trusted me to do the right thing, and I have failed at this miserably. All I did was add fuel to the fire and sully my name.

    As I said above, I personally accept responsibility for my actions. Anything anyone wants to say about me here is fine. I do find it inappropriate that some have found it necessary to take personal issues with me and slander my company on various film forum websites. My actions should reflect on me and not the other people who depend on my production company to help make a living. Charlie Maib fucked up, not Happy Chicken Group, LLC.

    Once again, my sincerest apologies to everyone on ASSEMbler. I have tried to set right what I monumentally made wrong.

    Preface; I wasn't involved with this but I did read the thread(s?).

    It is nice to see you have returned with not only and apology but word of full refunds. If this is true; I personally wouldn't have a problem dealing with you in the future.

    It takes a brave person to admit they were wrong; as well as exposing their personal life problems to online strangers.

    All you have done is proven that it worked. There was no response here for a month or so. Soon as people posted it got resolved.

    I think you'll find people were posting weeks ago and it had no effect, but if his circumstances were bad how could any words change that?

    In either case people understand that shit happens. Having been there myself (as have other good sellers here) it isn't always easy to find the time, motivation or ability to respond when you are in the middle of a perfect shit storm so thankyou HCK for doing so in weeks rather than months.

    As far as I see it though HCk is owed an apology too though I would chalk up some people's actions due to despair.

    Just replying to the thread (that he was coming here, logging in and reading) and just saying "Having some trouble at the moment, will refund ASAP" or even the same post as above - problem avoided.

    There was no reply, no contact. People tracked him down elsewhere and started to cause a fuss and now he is here resolving it.

    As I said, all this has done is proved it worked.

    Eh? It has been known he has been on other sites since he joined due to his unique nick name. That is not news. It is also not news for a business with a cashflow problem to advertise for more business.

    Also any publicity is good publicity - even sites with a fuckton of bad reviews get bumped up the Google search rankings and catch more suckers.

    Lastly assaulting his business when the issue is a personal matter is uncool. The two have a person in common but they are separate legal entitites. Personally, I'd be launching libel action for defamation of character but then again I am a cunt so :p

    EDIT: Oh and werejag as for the Data Protection Act 1998...

    The Act works in two ways. Firstly, it helps to protect your interests by obliging organisations to manage the information they hold in a proper way. It states that anyone who processes personal information must comply with eight principles, which make sure that it is:

    •fairly and lawfully processed;
    •processed for limited purposes;
    •adequate, relevant and not excessive;
    •accurate and up to date;
    •not kept for longer than is necessary;
    •processed in line with your rights;
    •secure; and
    •not transferred to other countries without adequate protection.

    That is just for here but most major countries have a similar thing. Failure to comply gets the forum into trouble hence the details had to go.

    members ignored the "we are a fraid of the laws that we think apply but dont moderators" and it has been resolved.


    if anyone needs to apologize its this group of ppl for protecting the site when it did not need any protection as it is very legal to do what was done and should have released info weeks ago instead of memebers finding it on their own.




    again hck i have no problems with you. you have always been great in my book.


    EDIT: for the record the fair use of the info wasnt given a chance since the site was protecting him.

    Actually, neither of those statements are true. I haven't actually read anything on this forum in quite some time. Twice, I think, I landed on the homepage when I meant to navigate to a different site; but I only went to my old selling thread today and even then I didn't read what people were saying, I just posted an apology.

    Why?

    Because I had responded to the 3 people I was having troubles with via email. One via Skype. So it wasn't as if I took their money and ran off and no one ever heard from me. I did the best I could with what I had, and as soon as I was able to scrape together enough money, I paid everyone back.

    I've already contacted the mods on the other site, hopefully that will be cleaned up shortly.

    I said that after people starting tracking him down on other sites and posting stuff 2 days ago - he is now here sorting it out.

    You said it was weeks ago, which it wasn't. It was 2 days as the links show. That is all I am saying. Your replies do not make much sense. Unless you misunderstood what I originally said? I dunno.

    Also, libel action? if its true, its pretty easy to defend against. Also, he clearly posts here with "Happy Chicken Studio" avatar. Very easy to suggest the person thought they were dealing with Happy Chicken Studios, if you wanted to go down that route. I doubt that would get very far at all. Also, its in different countries - if he is struggling for money, I doubt a court case in another country would be viable.

    You said you dealt with everyone via email/skype... if you read the thread in question, you will see someone who was having trouble with you says differently. He was saying you were ignoring Skype and not replying to him. So "taking the money and running" is exactly what it looked like.

    You should probably read the thread, so then you can see what it looked like.

    Edit:
    Infact, the person in question is still saying the opposite. This just looks like damage control after people found you on other sites and started causing trouble for you.

    Why would you refund the money if you still have the items that you originally sold?

    Surely if you are as hard-up as you claim to be, shipping the items and keeping the money you had managed to 'raise' would be more benficial in the long run?!?

    An apology is all good and well if the story checks out but if it's an apology for the sake of it then it's worthless IMO!

    (Let me make it known that I am not preaching here; I have had my own troubles in the past but like to think I set them straight in the correct manor)

    I think no matter what is happening in your life, you still have a responsibility, and must try to do what is right. But with HCK it seems that didn't happen at all.

    Yes, **** happens, but I think it should not be used an excuse or something, or to imply his actions were OK because, you know, **** happens.

    I'm not condoning nor condeming HCK's actions and I am sympathetic to both sides having been scammed and had selling problems myself. I don't even know HCK, I've never traded with HCK nor have I had any direct contact with HCK.

    I am however condemning some of the action taken against him, some of which had to be altered to prevent the site from being vulnerable to legal action. Libellous words or even legitimate hatemail is as bad as scamming as the means do not justify the end.

    Also werejag if you're struggling to understand it, the site wants to help, but it cannot do so by spreading personal details or inciting aggression to a business address as it is unlawful. People are welcome to be vigilantes as individuals, but what you need to understand is that the site has to remain impartial and have no part in it so that we can continue to help by providing advice and support to those who need it, as the site is no good to anyone if it is shut down.

    Whether people choose to listen and act upon information or not is another matter, but also someone would probably better off visiting their local advice bureau than speculating here.

    I know I havent been on the forum for very long, and dont know a lot of you, I know that HCK went trough a rough patch, we've all been there.

    But I simply dont understand HCK, why did you not send the goods, and what happened to the money originally paid to you?

    If you really didnt have the money you should have just shipped the items, and sold them as agreed, it would have helped your finances.

    If you had no intention on shipping the items, why list them in the first place?

    If you knew you where going to repay the person in a few weeks, why didnt you simply ask people for a loan?

    It honestly looked like you needed a loan for 30 days, and simply couldnt part with the items, hence abusing the people who bought from you.

    I am sorry but I am simply trying to understand your action.

    PS I do believe Assembler should look at this aswell as it brings a bad name to the forums, I know he said sorry, but he parted these people with there money for 30 Days, against there will.
