Well CAPCOM doesn't seem to care about what's happening with 1.5, so maybe Nintendo won't mind RE0 being released...

 

Sadly, Capcom and Nintendo are still two completely separate entities ...

 

Nintendo probably care little more than Capcom at this point, it hasn't stopped other Nintendo development items from making their way into circulation, items that are freely sold as collectors pieces today. I think Nintendo would probably be most interested in stopping first party titles and/or things that effect company privacy. It seems this item was gazetted a long time ago, and it's a very unique and expensive collectors piece, so it's not surprising that it's sitting happily and quietly in someone's collection. I would be prepared to buy the real cartridge your self though because that's likely the only way you'll get to play it in any reasonable time frame.
