OK so this is the situation. I had something up on ebay, a member here asked me to stop the auction because he wanted it and I agreed. I asked 100 for the item and 20 for shipping, received the 120 and shipped to address given by the buyer. weeks later I get a mail that he still didnt receive it, so I check the tracking and it says the address is incorrect (while i put down the correct address the buyer gave me + his mobile on the box!!) so some time later I receive the whole thing back and check the address and its exactly like the buyer sent it to me.. i made some pictures of it to proof it came back with the correct address on it (well correct, he claims its correct) so i offered the following: to send it again but this time as its not both our fault we pay 10 each and i send it again. but the buyer wants a full refund.. meaning i loose the 20 for sending it and loose the paypal fees for receiving the money in the first place and the ebay auction fees that would make a total of 28 lost on nothing. so out of frustration and irritation i sent 110 back (i still have more loss then the buyer but I dont want to pay everything..) am I doing the right thing? what would you do in this case?
I think the buyer here is being abit difficult. If you have provided the proof that its not your fault that its come back then i think the first option you gave them was the best he could of hoped for and i dont think he should of been given a refund. (Any online store would of given a refund minus postage) If he really wanted a refund he should of taken the circumstances into account and at least given up on the postage after you having taken it off ebay and so on. Next time tell them to bid on ebay.
If it's his fault the shipping address was incorrect, then he should be the one to pay for the postage. If the address was correct and the postal service was to blame, then it's a bit tougher - I think your initial plan to go halves is perfectly fair, and if he demands a refund now he should expect to lose at least half of the shipping costs, which is what you've deducted from him.

(1) Last time I had to travel for work and I send you the 120 + 6 euro extra back because I knew it would take some weeks before I was able to send it to you. (2) When I was back and had some time I sent u a PM but i didnt get a response so I put it on ebay, eventually you contact me that you want it and ask me to stop ebay which I did. I asked you to pay by banktransfer to prevent me losing money (again) on paypal but you didnt agree so I accepted the loss of money on paypal as I stopped ebay already. (3) I send you the package with the address you sent me and as an extra I put your phone number on the box as some countries requite this (like spain) I sent it by TNT-Post (the normal way of shipping in NL) and the package was insured up to 500 euro and shipping is trackable. Some weeks later after your complaint I check the tracking info and I see wrong address and it came back to me. (4) I made a picture of the offical documents on the box stating the address was incomplete and showing the full address you gave me printed by TNT to prove I didnt make any mistake on my side. (5) I offered you to split the costs to send it again 10 for me 10 for you, you didnt agree and wanted a full refund, but I didn't think its fair for me to loose 28 euro so I sent you 110 back (if you choose a banktransfer you would not loose your 3 euro something but hey.. you didnt trust me and insisted on paypal.) I dont see anything wrong with what happened, execpt for that you are not flexible and you call me stupid all the time by PM while I never had problems whatsoever both on ebay or here dealing with people. If you want to show off ebay feedbacks and whatnot fine, I have 100% positive and ready to show it any time, and I am sure there are enough people on this forum that would agree I am a legit guy. So please get off my back and deal with losing like I did, as it was your choice not to pay an additional 10 bucks to send it again and the fault is neighter mine or yours that the postman cannot find you eventhough I even put your number on it.
I probably would have just offered to send the package out again. He purchased it, so it's now his. If he wants it, he can chip in for the shipping, or come pick it up himself. If he doesn't, then throw it in the trash for all you care! You were more than fair to split the loss with him, so I don't see why he should loose nothing and you everything.
I would of been better if they would just lost the package, then both him and me would not loose money on it and I could ask for the insurance to compensate him. But try and get a refund from the postoffice for just the shipping costs and they start laughing while it was obviously their fault it wasn't delivered. What I really don't understand is that they didn't try to call him. For all I know he decided not to accept the package because he found another cheaper and told the postman to send it back.. because I can't believe how they can't find an address that if the buyer is telling the truth send so much stuff to and that they didn't try to call him to check the address if in doubt. But I am not accusing you of nothing kaori, I am sure you are telling the truth (even if I wasn't sure I don't care anymore) and I just want to get this shyte over with, we both lost that's it.
What I would do: Send it back to his correct address and not give him back anything. He wanted to deal outside of ebay, that means he loses the protections. Sorry Kaori.
well he filed a dispute on paypal now, they deduced another 120 euro off my account until the dispute is resolved after i refunded him the 110, so now im 230 down the drain.. just because he wants to be a prick about it. let it be known to other people dealing with him look out

I paid !! i don't know the legislation in your country but in France you have 7 days to send back item you buy on the net to get back all monaie
LOL 100% positive for me and you have 8 negatives and 7 neutral this year alone, yes you are right also it was you who asked me to stop the ebay auction i have the pm's you sent me about it. Plus Paypal told me I dont need to refund the shipping to you, you choose to go down this road with the claim so now you probably only get 100 back instead of the 110 i sent you. Then after i sent u the 110 you claimed the original 120 so that makes you a criminal in my eyes because you want to steal my 120 on top of the 110 i already sent you.
So you think its ok that after he sent it to you got it returned you get 240 euros back? I think its time you stop the paypal charge back and took it on the chin. He sent the item to you and your responsable for postage costs. At the end of the day if the french post couldnt bother to look for you its not his fault and he gave you a generous offer of paying half of the return postage. More then what i would do. Sort this out before your banned for the forums.

From the original post i think port187 was being fair, he sent you the item but for some reason out of his control it never arrived at kaori30's address and was sent back. He offered to pay half return postage and send it again which he did not have to do so i can't see why you never decided to let him send it again because you then say you don't have something you paid 120 euro for. Its not port187 or your fault kaori30 that it never arrived if he sent it to the address you gave him and you should just have this sorted out by either getting the item re-sent to you or getting your money minus the shipping costs back. (no offense to you kaori) but i don't see why you had to file a paypal dispute when port was being fair and was prepared to re-send the item out.
Jesus christ, kaori. I know there are foreign people on this board, but I can't understand a word you are saying. Seriously, this sounds really fishy.
Issue is resolved, paypal claim was revoked. Sadly I knew the day would come I would encounter problems with shipping, it's something you can't help sometimes the only thing you can hope for is that the other party is nice enough to work out a fair solution with you without unneeded escalations and hustles. Anyway it's all good now, and on the bright side I learned alot about how paypal works and what my options and rights are in case I encounter then in the future. Thanks for everybody giving advice.
I'd never refund anything unless you know its safe. Such as, you got your item back, whatever dispute is resolved, etc. Otherwise people pull this double-charge shit and dispute with PayPal after you refunded them. In this case your lucky, but in the future?
