What BS. Thats why I generally only take money orders from people I don't know. It works as good as cash and if people are trying to screw you over, you just go... <Makes washing hands motion>... "Your being unreasonable, I have no reason to work with you, I have your money so screw off.."

Nah, I don't give out names. When you do that you lose control over the communication.

The guy actually wrote me a note saying he was going to drop the dispute....but he hasn't done it yet. I basically wrote an email on the PayPal dispute "confirming" that he's filed the claim not because he thinks I've done something wrong but to extend the coverage. I think he realized he's made a mistake by putting his reasons in writing...heh. He doesn't know I've contacted PayPal and gotten fucked over by them....but sometimes winning an argument is more about what you know the other guy doesn't know... We'll see how it plays out.

And yeah, in all reality about 99% of the Buyers are good people. I have a 100% rating with over 3,600 feedbacks, but I can promise you I'm not perfect. I've made some mistakes and most Buyers have been really cool about it.

What I would do, going foward:

    A) Only offer air mail shipment to Spain from now on, and explain exactly why this is so in the auction description.

    else

    B) Just stop selling to Spain, period.

You may loose potential customers this way, but I'm sure you won't miss the aggrivation.

The problem with what this buyer is doing, is that he could decide to just claim the package never arrived if he felt like it and just rip you off. One of these days someone is going to hit Paypal with a class action lawsuit because of these kind of abuses.

Is that really so MANY spanish customers have scammed you? I don't know how spanish can scam more than british, french, italian or americans.

If he just says "fuck you" at some point and leaves you withouth any money because of PayPal giving it back to him, you can hand his address to some of us spanish residents and could try to fill a complaint for internet delicts (which won't work but a miracle could happen ), anyway, I hope you stop selling to spanish. :crying:

The problem is not Spain - the problem is PayPal.

How could a company refund money to the buyer if delivery takes too long, even as it is known that delivery takes 2-3 months?

Well some of the facts of the case are being changed a bit.

He filed a dispute, not a claim. A dispute will stay open for 20 days. During that time the Buyer and Seller communicate with each other on PayPal's message system and try to resolve the problem. PayPal isn't involved. Since the guy knows I've done nothing wrong we don't really have anything to say to each other.

After 20 days, two things happen. The Buyer does nothing, and the dispute expires, or he turns it into a claim. Turning it into a claim means PayPal becomes involved. That's when they read the comments of the dispute, check the tracking number, etc. Then they make a decision which could include giving the Buyer a refund, giving me my money back, or putting it on hold to see if there are any future developments (like the package arriving).

A Buyer has to file a dispute within 45 days or he gives up his right to file one. So, that's why the Buyer has filed a claim. He waited for 40 days, then filed a dispute, thereby extending his protection for another 20 days. That way he gets 60 days of coverage. After the 20 days expire he'll most likely turn it into a claim and PayPal will get involved. Since only 60 days have passed and the shipping is 60-90 days, they'll most likely put it on hold and see if the package arrives in the next 30 days or not.

The package will probably arrive sometime during the hold period, the tracking number will show that, and PayPal will rule in my favor. That's when I get paid.

And that's how you turn PayPal into your personal escrow service. And it's completely legal under their system, even when the guy says that that's what he's doing.

I'll probably stop shipping via SEA to Spain. Or I'll send an invoice for items that aren't goods. If you send an invoice for a service and not goods then the Buyer can't file a claim. He can do a charge back on his credit card, but he can't use PayPal's claim system. Since most Buyers don't know this and don't know the difference in invoices they might get my invoice and pay for it thinking everything is cool.

    Happy days!

I also found out today that after paypal finally looked at the pile of faxes they receive, they have noticed mine and admitted that I returned the item.

I have received my refund for the price of the item (although I have spent around £15-20 returning the item, sending the fax and sitting on the 08707 phone line to paypal, which I will never get back).

Ah well, at least I'm only £20 down and not £100 down. Better than a kick in the teeth I suppose...

ahem... how am I supposed to understand this?

Okay, there's loads of idiots here, no doubt. When we'll put idiots into orbit, France will lose half of its population. But there are still some who aren't. I've already bought many things from japan-games on ebay. No problem so far.

@ japan-games, if I were you, i would stop using SEA shipping. yeah i know, I'm not the first one to suggest this.

Problem is the minimum shipping charge for online tracked airmail is 25€ to USA (up to 1kg, even if it is 10g).
Who wil laccept to pay 25€ shipping for a 5€ game? No one :(

Thousands of dollars for items that have a total cost of 10-20 euros? You've been scammed hundreds of times?
