Even if the game are not released copyright still apply on those binary aswell good exemple is starfox 2 yes it suck the game was not released but selling a repro of this game is piracy.

I understand that not everybody has the skill to do a repro cart or even a nice looking one.

I have personnaly no problem with people who sell repro cart clearly as repro cart and that understand that what they doing is piracy.

Also the Atari case is a bit special. The compagny intellectual property and trademark was sell several time and I think that people at Atari now don't even know the history of their trademark. So AtariAge reproductions (like Saboteur) might not be big enough to interrest atari lawyer. But remember that atariage has to remove a pac-man repro cart from their webstore because namco say so.

Also I don't see the point to insult assembler member, people who say that repro cart are piracy are right, and people who sell repro cart as repro cart to share great unreleased stuff with people who have less technical skill are right too, as long they understand it's piracy and clearly stand in their auction that they are selling repro card

Who cares if he sells repos?

Its not an exact copy of any existing cart. If somone is "fooled" then they just don't have a clue. If they don't have a clue then they just don't care and then who cares. Everyone should do their own homework before bidding on anything. I'm guessing he didn't call it a repo because he didn't want eBay to pull the auction not because he was trying to fool people.

Freelance tatletales with nothing better to do are whats keeping most of the dev items off ebay pages.
