Why haven't Watermelon's Magical Game Factory, or Super Fighter Team, been taken out by the big boys?

It's a game of chance. Terraria's developer made some mario game and was targetted and had legal action taken against him. Capcom hired and paid the guy that made the recent street fighter vs megaman or whatever it was, it's all a big game of chance.

If a homebrewer doesn't use official SDKs (without a license),
Makes original characters, graphics, music, and storyline,
Uses some kind of Legit, and/or Open Source method to get their games to boot,
Writes the standard "Not licensed or Endorsed By..." on their Cart Labels, Packaging, Manuals, and Game Boot-Screen,
similiar to how Action Replay, CodeBreaker, GameShark, GameGenie do it,
Doesn't use any Registered Trademarks or Logos, without permission...

Then what's there to sue over, when making games that way,
for NES, SNES, n64, Sega Master System, Genesis/Mega Drive, Saturn, Dreamcast,
TurboGrafx/PC Engine, Atari Consoles, ColecoVision Consoles, and IntelliVision Consoles?

Ya know, Mattel opened up the Jaguar to Homebrewers a while back.
Ya just gotta not claim that your game is official or licensed by Matell or Atati corp,
and ya can't use their logos.
