With all the stuff sold when Acclaim and Interplay went out of business it would seem the courts saw it differently. If they didn't all the dev items sold through liquidation never could have happened.

  2. How it works is basically this...

Once a Dev House is declared bankrupt an Official Receiver (OR) is appointed.

The OR quickly list's the companies assets.

...At this point it doesn't discriminate or seperate out any item, it just lists the lot, from a packet of paper clips to the carpet on the floor, it's all added to the inventory.

Then it trawls through the legal papers to find out whats on lease, whats owned outright, whats part owned etc, etc.

At this point it usually works out what is what, in legal terms...

...So then they write letters to those concerned 'offering' to return any items on license or hire, etc, basically anything that 'isnt owned is offered back to the rightful company.

They usually have to give the rightful company a period of notice, usually 6 months, with an intention / warning that the items will be sold if they don't claim them back within the stated period.

It's after this period of 'non-claiming' that the goods come onto the market!

...Basically the companies that don't reclaim have made a 'mistake', a mistake in that they had the notice and 'filed' it, rather than acted upon it!!!

So there you go, their 'mistake' = Pure joy :)
