I'm not really going to dive into the thick of things here, but in case people are having a hard time understanding, Intellectual Property, whether on something released or not, is always copyright of the creator until they say otherwise, making beta software of something not in the public domain and not licensed for distribution ILLEGAL. It's illegal to sell and illegal to own, period.

And Nintendomad, I would think it's not really the best idea to demand that Sega start taking action against people involved with PA, especially since you can't be completely sure that everyone selling the software on eBay is totally ignorant as to its origins... :smt009
