    A US man has appeared in court after he tried to download the $US6m ($7m) code of the soon-to-be released video game Breach.

    WBZ reported Justin May, 20, of Delaware, was attending the March PAX East 2010 in Boston where he allegedly used his laptop to hack into an Xbox 360 Test Kit that was demonstrating Breach and downloaded the code.
    Breach was being shown for the first time at the convention by Atomic Games, a subset of Destineer.
    "Breach, and our Hydrogen game engine, are the result of millions of dollars of investment and years of hard work," Peter Tamte, president of Atomic Games, said.
    "It would have been very harmful if Breach had been posted on the internet months before its planned release.â€￾
    Mr May faces charges of larceny and buying, selling or receiving stolen trade secrets.


    If convicted, he could face up to five years in prison or a $US25,000 fine for the first charge and up to five years or a $US500 fine and imprisonment of up to two years on the second charge.
    He was released without bail and is due back in court on June 27.

    So what do people think an appropriate sentence would be for him? Personally, I think 1 year prison time with 1 year probation.

    First offense would be 14-30 days or probation,a fine, and terms for the next 4-5 years of staying out of trouble.

    Putting this kid in jail is a waste of taxpayer money. He's young, he was stupid, and I'll bet he has learned his lesson. Let him off easy.

    5 years does seem a tad harsh.

    We'll make a petition gamers can sign agreeing 5 years is too harsh! Bad idea, or is anyone interested?

    I call bs, and was an inside person, and the whole thing is just a scare tactic to people that have kits they shouldn't have, just like I am starting to believe the kit killing was all a scare tactic started by M$ to keep people with illegal kits off of PN. Seriously, how would he get said code off the kit, unless it was using a wireless adapter? And do you think they would have a wireless adapter on a kit with that code on it, in a place filled with laptops and other electronic devices? I call bs, and made up story, plain and simple.

    Its microsofts's fault for bringing anything worth 6 million in a non airtight secure pc to a kids (I mean who else goes to PAX or bothers with penny arcade) convention.

    Dragging this kid through the mud is a cover up for the idiot IT guys who were sleeping on the job.

    If he is anything in person like he was here then he best pray he doesn't get jail time. Otherwise he'll be on a first name basis with the folks in the hospital ward.

    yep, I found the account and snapped a pic of it about two weeks ago when I was checking how big the leaderboards actually were. Guess the word made its circles pretty fast.

    Pretty sure the dev's were just poking fun at him by registering such a tag though ;P.

    The court arraignment happened just the other day, so no, this isn't really all that old.

    The media always quote the maximum sentence for sensationalism.
    Also, as he didn't get the whole game, it would likely be looked at as attempted theft. The 'released without bail' in the report suggests that it's not being looked upon as a serious offence.

    As long as he doesn't act like a tit in court, i'd imagine he'd get probation.
