Man faces five years' jail after caught downloading Breach code off XBox 360 Test Kit

    A photo of him was published with the story of his arrest and someone recognised him.

    Lets look at this realisticly, apparently he bragged to pax staff he was stealling their game, he also apparently was ready to drop names of people who sold kits, he skipped his first court date to play modern warfare 2 online. This can all be found in news articles on the internet.

    Based on this bahaviour, if i was the judge, id throw his ass in jail in a heartbeat, not because i have anything against the guy, but simply because of his blatant lack of respect for authority, especially when its being reported on in the public domain.

    According to reports and forum posts all over the net, the guy has been a dick.
    The judge will be looking at the facts, opinions have little relevance when sentencing.

    As long as he can convince the judge he regrets it and sees the stupidity of his actions, he'll get off lightly.

    Prison is usually for people who pose a danger to the public or are likely to reoffend if released.

    Well, I found an article that had this quote:
    "May had been seen hanging around Atomic Games booth prior to the attempted theft, Tractenberg said. And he made his move when the person watching the booth's laptop left to use the bathroom. An observant QA tester spotted May standing over the company's equipment with a laptop and a cable running between the two."

    I guess it is true, or perhaps he is still a paid participant in the theatrics, but I am failing to believe that anymore. I was saying that nobody in their right mind would have it available wirelessly, because I figured that was the only way he could get away with it, and get the files to a laptop, with all the security around the equipment and stuff. I also thought that it was an Xbox 360 game and he was supposedly getting it off of that. This thought on my part, however, was before I saw that it was he who wasn't in his right mind. Seriously, he is either very, very stupid, or he has the biggest sack on the planet to do something that crazy.

    The fact that he missed his court arraignment answers my question about his intelligence or anatomy. :thumbsup:

    I'm serious when I say it's likely he does have some sort of condition. His superiority complex is a typical thing you find in people that have acted the way he has. Just nuts.

    Have to wonder what he'd say if he were still posting here. No doubt he'd come up with SOME defense that he thinks justifies it, that's how these people are, there's no changing them into thinking they're wrong. His history here proves that :)

    didnt he also get charged with trade secret buy/sell/trade when they went to his house and took his kit?

    I always thought these tactics were a bit stupid when it comes to charging people with crime... His kit should have nothing to do with what he got caught doing, unless it is to be put up for evidence on his own accord.

    I agree - this case should be enough to scare anyone from doing it again.

    Some people would manage to protect that code instead of letting people get it.
    It might sound really simple but it is.

    "Oh let's leave my phone here, I don't think anyone will be attempted to get my numbers."

    The thing that bothers me the most about it is, the game company could have put any value on that data. Is it really worth $6,000,000? Who knows. I really doubt they would have lost that much had this been leaked.

    Since he only stole 20MB, a small unusable percent of the whole game, shouldn't the value he stole only be small percent of six million?

    He may be a douche, but 5 years of his life taken from him for such a thing just seems off to me.

    I think it will be accused for the attempt and not for the percentage downloaded, since it will be quite unusable.

    I hope they are lenient on him - yes what he was doing was wrong but I think he was stupid more than malicious!

    excuse me? PAX has become a high profile show now. The show gets coverage by all the gaming sites, lol wtf. And Microsoft didn't bring the hardware, a developer did. But um how else are you going to show proto hardware except on test kits?
