    Damn. Sorry to hear that :( If it is already in the local Deffenbaugh dump there's really no way to get it out. I'm hoping the cleanup crew hasn't got to it yet.

    I know it's been said already, but I too am really sorry for your loss. Have you tried speaking to the company managers, therefore bypassing the chumps who just don't give a damn? You've offered $1,000 to anyone here who may be able to help, but you could always try the $$$ approach with the shipping companies too.

    Be very, very careful if you do talk to them directly. I realize that you would much rather have the items than the money, but they could say that your items were not insurable under their terms of service and screw you over twice by denying the insurance claim as well.

    I think this case is different because its not a single package but a trainload of them. I don't think its coming out of their pocket otherwise they wouldn't have been so quick to discard the entire contents. Some insurance company somewhere else is paying for this.

    That hurts... a lot. Was it at least insured for as much money as you put into them? That would soften the blow a bit (but yeah, would still suck monkey cock). Man, I hate American box art and shit but still... you're right. One of a kinds going up in some train accident... how the fuck do you wreck a train anyway?

    The really sad part is that the stuff will probably end up in an insurance auction of some form. Actually, that could be a thought: go through their insurance company. I'm sure UPS probably doesn't underwrite their own insurance coverage, so you might have better luck dealing with whoever actually insured the shipment. In most cases, the insurance company pays out on the premium and then takes possession of the "damaged" items. They are always looking to recover some of the cost, so they might be willing to deal with you directly.

    I think you need some advice, so I ll step in.

    1) Find the insurance company they are using. The idea is to make the Insurance company and the Courier to fight as corporate entities.

    2) Tell the insurance company that they wouldn't have been liable to pay for your items (which are one of a kind) had the courier not thrown them away. Give them an insentive, telling them that "If i can have my items back, you will not have to cover my loss and I ll reward you, too"

    3) pit them against each other, making the courier look negligent and unprofessional for treating you, the customer, and the goods, that are one of a kind, in such a manner.

    You could use the following argument:

    "The Courier has taken the easy and irresponsible path of choosing to claim the insurance, from you, the Insurance Company. Although this might be fine for most items that can be replaced, this is not the case for my items.

    Since I have had contact with the Courier since the first day of the accident, they could have easily not disposed of the items and thus not claim the cost from you. Instead they should allow myself or a representative to pick the items up, avoiding unnecessary expenses for you - since the items were not damaged, but dumped- and at the same time saving these one-of-a-kind subjects.

    Since there is evidence that the items were dumped and not destroyed in the process, you could potentially want to investigate further into the matter in order to establish any breach of contractual terms between you, the insurance company, and the courier on the matter of items being dumped when they could have been salvaged.

    My only interest lies with my shipped items, nevertheless, judging from the reckless way they have treated the situation thus far I wouldn't be surprised if your money is being spent where it could be saved, had they salvaged the remainding items instead of dumping them."


    Insurance companies love to sue their clients for breach of contract, or establish ways to avoid paying.

    go for it, trust me.

    Here's a tip: Use FedEx next time and ship overnight. It's worth the extra money, especially for one-of-a-kind items.

    I'm very sorry to hear this isn't turning out well at all. When I first read your post about this I had my fingers crossed that this would turn out positively for you, but it's looking like UPS want to be total douchebags and write it off. I understand for a business standpoint that they don't need to deal with you, because you didn't initiate the transaction and therefor aren't technically a customer, but I've never heard of such shitty treatment. I know fullwell that this could have happened with any courier but I would like to think that this treatment is out of the norm - I'll stick with DHL when I have the option.

    Curious - what were your plans with all that original art? Museum exhibition? I'm sure you could easily hold one with that load plus what you've already got.

    there hasn't been a single courier company, including DHL, that hasn't damaged at least *some* objects I've shipped with them. They re all very asshole-y when you demand something from them, even when it's compensation (and even when insured!)

    I remember insuring a computer as a whole and they only refunded me for the damaged components, despite the insurance contract describing the item as a "computer", ie a single undivided unit.

    The plane could still go down... Despite how UPS treated him, it's hard for ANY carrier to avoid situations like this...

    If the stuff was being hauled to a dump, they aren't going to haul it far... But I doubt it was dumped. ANYONE would know there's a LOT of valuable stuff in a trainload of personal/business packages. If I owned the hauling company, it would all be coming to my personal storage yard first, sorted and THEN dumped. Unfortunately, I could easily most people thinking the Atari stuff is worthless drawings...

    I'd have to agree with others here- Try to find out who the insurance company is... If it really has been hauled off (which I could believe if they weren't sure if there was some kind of local contamination), try to find out who the hauling company is and talk to them. Those kind of companies tend to be reasonable if there's cash involved.

    If you can't get that information through normal channels, just start calling hauling companies in the area of the accident... Someone would have to know who got the contract to clean it up.

    Is that Tempest art the actual art for the arcade game? It's weird, I was asking if anyone had that at CGE, and now it shows up here (even if it's not the original artwork, it's still cool...) I'd almost be willing to spend a few days scavanging around Kansas myself just to save that piece!

    Does it rain a lot in Kansas? That might be another concern, if the boxes are outside it probably won't take long for weather damage to destroy them for real...

    Good luck with this, hopefully they aren't really lost forever...

    I really hope that these artworks will pop up somewhere. This could be one of the greatest losses in videogaming history. So many important artworks...

    ...I hope that you find a legal way to reach the items.

    If not, it would be interesting to write a public article and touch the community to see what happens...
