Guy on ebay trying to scam me!!

    Ive got a somewhat unusual scenario.... I just won an auction on ebay for a PS2 cheap console, except he has the shipping listed as $100.. Obviously there is no way the shipping is $100 and he's just trying to suck me dry. Ive already won the auction, so im obligated to complete the transaction one way or another. Does that legal obligation work both ways though?? Is he now legaly binded to sell me the PS2? Because if so, I think I could probably make his little scam blow up in his face and make him sell me that ps2 for $60... LOL.. Because there is no way he could force me to pay $100 shipping... What do you guys think??

    I'd report him to ebay and send the message that he tells you to pay $100 for shipping.

    Was it in the auction? If so, you're most likely SOL.

    This is the key phrase right here...

    "Sellers may charge reasonable shipping and handling fee to the final price of their item"

    I think I just got a cheap PS2... There is no way ebay wont see it my way... $100 shipping?? C'mon.. Im not going to let this jerk off the hook either, I'll call police, lawyers, whoever, he's selling me a ps2 for $60... Your legaly obligated to follow through with ebay transactions...

    While ebay can make it lessthan a hundred, he can still charge like $20 for shipping, but you are still getting a PS2 for quite a bargain

    Or he could say "fuck you", not sell it to you, and leave you negative feedback (which will likely happen).

    It's illegal to do that, but you should've read the bottom before bidding. I'd just suck it up and pay, since, while he screwed you, in the end it is your fault.

    oh i'll definitly pay,... $20.. but not $100... I dont have a problem paying..

    and if he leaves ME negative feebback and tries not to sell it to me, I will leave him negative feedback, have his feedback deleted, and I'll take it to the next level and enforce the sale... There are actions you can take..

    I had similar case with another eBay seller late last year.
    this guy was obviously wanted to sell it locally - i.e. in USA - instead of shipping overseas and listed S/H for $39 when the starting bid was $0.99. I won the auction at $1.99 and he told me s/h will be $39. Now I would've paid him what he asked except I won another Xbox game from another eBay seller in the same city as he and the S/H was $10 for the exactly same shipping method. When I asked him why he charges so much compared others and he said since he said in the description that I need to pay no nothing... I was going to ask him whether he can charge me the actual or reasonable shipping fee but instead I said screw you and left him negative feedback. Of coz he left negative feedback in return and I left some informative feedback comment. Few days later he asked me whether I'd agree to recall negative feedback on mutual agreement. I told him get stuff'd coz I don't give a sh*t about feedback really and I have no intention to withdraw my negative feedback...

    over the years I have had several negative feedbacks for various reasons but I never give it much thought... I mean if someone's not gonna sell me coz of my negative feedback three years ago well that's fine by me...

    I'd say screw him and don't send any.
    also leave him the negative feedback being such a jerk.

    tell him to go fuck himself...with a broomstick or toilet plunger. No way in hell i'd ever pay $100 for "shipping"..even if it was meant to make the deal look better.

    The only time I backed out of a bid was because the moron would only send to a confirmed address, which isn't where i am right now. It wasnt stated in the auction anywhere, yet he expected me to pay.

    yea, but i think your missing the POINT... I WANT the ps2, and I WANT to make him sell it to me for the ending price of $60, except Im going to fight the shipping fee... Your case is quite different, because it was only $39 and YOU were the one who backed out of the transaction. You do know that his leaving negative feedback on the basis of you leaving him negative feedback is against ebay rules dont you... Its called retaliation feedback, and you can report it to ebay and have it removed. Not only is it against ebay policy but its against the LAW.. (US law).. You can file for defamation. Negative feedback can deture prospective buyers. And if you can prove that the feedback is warrentless, you can sue..

    People are funny on ebay... about 60% dont know that ebay is not a joke, and its not a world without consequence.. I have to constantly deal with these newbs who dont seem to understand that its not ok to bid and not pay.. I get emails all the time saying "oh sorry, didnt read the description, I have decided not to buy", as if they have that option... YOUR LEGALY OBLIGATED TO PAY.... I also get the classic "my kid was bidding and he didnt know what he was bidding on" routene... I have consulted legal help in the past, and know exactly how to go about doing it...

    well I don't live in US so who give hoot to US law anyway. ;p
    and the seller told me he really don't want to ship to overseas and if he had to he want $39 for shipping even though it will only cost him $10 for actual shipping. So I didn't pay. If he was cooperative and helpful I wouldn't mind to pay $15 or even $18 but with that kind of attitude I don't have to deal with... for leaving negative feedback well I leave it all the time - if the shipped item is not mint although auction said mint and virtually new I give the seller negative feedback. I can't waste my time to sort things out or that kind of crap... well others are different but that's what I do as eBay buyers...

    for legally obligated to pay... yea! nice word but do you have any idea how many zero feedback users are bidding on ebay? I set up my auctions for only two or three countries and any zero feedback users I cancel their bid right away and ban them from bidding on my auction in future!

    I bid on items I want and normally I paid them in due course - I don't pay right away unless I know the seller as I've burnt few time when the sellers disappeared after I sent the money... now I wait for 5 days and if the seller does not send me invoice or any other means of communications I simply wait and see... as long as it takes... I've learnt the lesson hard way.

    Legally he is correct, but a judge would never hold you to it, as it's deceptive.

    Well, you can always try being polite, like getting the weight and address from him and calculating the shipping yourself, then politely send him and e-mail with a "I found a cheaper shipping method," attitude and see what he says. Play it off like you're niave to the fact that he's trying to rip you off.

    If he's honest, he'll accept your revised shipping charge, and you should proceed.

    If he's a dirtbag, he'll refuse, and you should tell him to go suck eggs.

    Chances are though this guy sounds like a punk, and will problably send you a box of rocks. Only one time did I bid on an auction with an overinflated shipping charge, becasue it was a "buy it now" for $1 and the shipping brought it up to what the item was actually worth (as in the guy just wanted to unload it without paying ebay for a higher listing fee. I could understand that. )

    Ryangassxx, I was in the same situation when I won a French model of SC-3000 time ago. He tryed to make me pay a big quantity for postage from France to Spain and I refused to pay it. I asked about rates to the French company which he used and I could know that he was trying to cheat me. I got in touch with him again and he didn't answered. Finally, before I could report Ebay, he removed his account. I've his personal info so I'll report Ebay to evite any account from this man...

    The fact is. If he lists $100 as the shipping price on the actual AD. Then the only person breakign the contract is you if you dont pay it. You can speak to the guys and see if thee are any cheaper options, but if he will not shift then you will have to cancel the transaction. You cannot leave negative feedback to a seller who is doing EXactly what they said they would BEFORE you placed the bid.

    Dont get me wrong, I hate it when people scam others with postage on Ebay, However, as others have stated on this page, if he didnt list shipping, and then came back to you with a price of $100 dollars you could then appeal.

    I would back out of hte auction, the only reason the PS2 went for this price is that others probably noticed the shippign price and didnt bother.

    Yup, you should always check the shipping price. If it was written there all along, then eBay might turn round and say - hey, you bid on it, you accepted his terms. If however there was no shipping price, then you could claim that he is charging an unfair amount.

    Where is he from, and where are you from? He isn't shipping from Japan to the US or something?

    Ask him if you can pick up the PS2 from him, he can't really refuse that. Then, have him put it in a cardboard box, and get a courier to collect it - that should be cheaper!!

    To be honest though, $60 for a used PS2 doesn't sound that great a deal... you have to add shipping to that, which would be what, $40 reasonably? That's $100, and what are they new? $200 or less? So a store that sells them like EB or any local second hand store will do them for maybe $130-150 second hand - and you get a limited warranty on that. To me, a local seller that gives a limited warranty is worth that bit extra, and you can actually SEE the thing working before you buy if it is a small store that has a TV they can hook it up to.

    If it's not too far away, go pick it up in person :smt043 . That way you won't have to pay shipping.

    If not, though, I'd just go with the "go fuck yourself" approach.

    IMO you are the one to blame if it stated $100 shipping. The only thing you can do is report the seller to eBay for fee avoidance and leave a negative. I would try to get them to lower the shipping and if they don't then do as I stated above. The legal mumbo jumbo is BS. Are telling me you will pay a lawyer at least $100 and hour to fight this guy in court, what a f'n joke.

    Given that it's an ebay violation to charge an unreasonable amount for shipping, the seller's the one who has screwed up. It's a sham either way and the seller deserves to get fucked over.
