    Damn Borman this is a crappy situation to be in! Hope everything works out alright, I think it should do, it seems you've done everything to be covered by sellers protection. I never recieved an item once from eBay so I made a claim, the seller did not use full tracking and confirmation of delivery, could not show where the item was and lost the case. Had they done so the sale would have went smoothly as there would be no argument as to where the item is, and any case would surely have been won on their behalf. Same thing here, you can provide information showing exactly where the item is and that it's just laziness on the buyers behalf which is preventing them from getting the item. Never get too over confident but I wouldn't worry too much about this, this guy is a scum bag and not a very clever one at that, I'm certain you'll get your money back.

    Actually, you are wrong. (but morally correct!)

    The item is the responsibility of the seller until the buyer has the item. This is why when things get lost in transit the seller has to sort it out. Paypal and ebay work on this policy, as does any other business.


    However, this guy is being a pure asshole and is exploiting this to his gain (as he clearly doesnt want it anymore).

    Also, anyone who thinks the responsibility for lost items is the buyers (even if the buyer refuses the option for insurance) is completely wrong. Paypal will refund the buyer regardless of your terms. Paypals T&Cs > your own terms.

    Exactly my thought, but that ninja avy scared me to hell lol.
    Wouldn't wanna lose business from you though.... It's a leap of faith actually, and still the sellers responsibility.
    That's why I always wait with feedback untill I get confirmation of receipt (!).

    A while back I oredered a piggy-back battery for a DS phat. It arrived DOA (new though) from China. Contacted them and they asked to send it back.
    Since it would've cost me the same amount for that, they just refunded the money.
    Was a good thing I actually made a thread abou the item itself on GC-Forever, which I supplied to them in the correspondence mail.
    All in all, they had a great service and follow-up for a small Asian company.

    Well, naturally there is some due diligence on the part of the seller that I omit/gloss over, but it seems everyone got the spirit of it anyways. :)

    Try calling paypal...

    Be firm, but not an @$$. You will probably need to speak to a manager/etc.



    I had $400 package go missing during the canada post strike, USPS shows it left my PO but never the USA. Buyer filed a claim/won so I called PP and explained to them what happened. I had $$$ back within an hour.

    Ebay finally responded!....

    Saying they need more time. They forwarded it to customer support. Clearly not a case they see very often, when the buyer simply refuses to get the package.

    Good to hear, they will hopefully right the wrong instead of opting for the buyer's inability to uphold values...
    One question though: why Ebay? Don't they actually report to the IRS for large sales... (I know there's at least some thruth to that if you have a certain amount of total annual 'income' generated through services like Ebay.) So 'why not sell here' is my question.

    Wider audience = quicker sale. Simple as that really. And it worked, if not for this whole situation.

    A lot more people visit eBay than forums. More potential buyers on eBay, more exposure. Maybe?

    Dude you could change it if you wanted to. Just stand up to the deal and give the man his money.

    Why are there always ppl like you around when dealing high value items...

    And dont come with stuff like oh, idk that they are on vacation and can not pick up the package, I mean seriously you wouldnt let the package ship to somewhere knowing that nobody is gonna pick it up, or would you?

    Anyways I think this thread is fair enough to keep ppl away from doing business with you.

    He admitted that other packages have been delivered, so they certainly weren't on vacation the whole time, if that is even the case.

    eBay usually responds to this type of situation quickly & rationally. As a seller (and buyer) I've had some items damaged/lost in the post, and they're quite fair. Because if their affiliations w/ paypal, they're able to forcibly refund or complete a transaction if something goes awry.
