David Thomas...Anyone heard from him?

I have sat on my hands and refrained from posting in this thread because this does seem pretty out of character - I have had a few fairly successful dealings with David. Having said that - there was always a bit of drama involved with health issues etc which then escalated to deaths in the family and now a car wreck. The long and short for me is that I am down about $80 for a SmartXX that never materialised and apparently got lost in the post despite paying for tracked shipping. This is very small change to the losses many of you guys have posted about and I know of a couple of others who have not posted here who are also down big time.

I do have David's home address and phone number (from the shipping dockets of previous dealings with him and also where I have posted stuff to). The number does seem to be from the area of that address. I have tried calling that number several times and got an answering machine. A couple of days ago I left a message asking for whoever picked it up to let us know he is ok or even if he no longer lived there etc - I received no response. Tonight I tried calling again numerous times and the phone is quickly answered (I could very briefly hear voices/tv/radio in the background) and then hangs right up. When something looks like a fish and smells like a fish, it is pretty much always a fish and this smells and looks pretty fishy to me now.

I am in the UK so not much I can do from here but in view of the large sums of money involved it would seem that it is time to try to find someone who lives nearby to go and knock on his (or a neighbours) door and find out exactly what is going. I hate to say it but I don't think it would be out of order to report it to the police either.

I truly hope that there is some other explanation to his disappearance but think it also fair that you all look after your own interests too.

I don't think it would be right to divulge his number or address on the forums, either public or via private messaging but I am happy to pass the details on to a Mod/Admin to let them decide who if anyone to pass the info on to - I hope that is fair.

He does, from the address I have he lives in Hollywood Florida.

 

yes, time to take action, you have all been more than patient enough. reverse the roles and you can bet he (and a lot else doing transactions on the web..) would have taken action much earlier.

 

If it comes to this; your only recourse maybe to take legal action of some sort.

Local Police department may not be of much assistance other than filing a police report. They can’t act on your behalf unless you can prove that a crime has taken place. They may offer advise to seek legal counsel and sue as a civil case.

Problem with this is that many if not most of you are not near by to sue under small claims court; nor could you afford an attorney to represent your case. From these posts that I have read … this is affecting people across state lines and some out of country. You need to involve someone that interacts with agencies at a Federal level.

I suggest that you file a complaint with the Internet Crime Complaint Center. If David Thomas operates under a business name - you can also file a complaint through the Federal Trade Commission. The point of filing a complaint is to have someone in your corner regardless of where you are in the U.S. I would also urge those of you that are out of country to file a complaint online with ICCC regardless of the monetary amount/value of your items. The more of you that step forward and file a complaint … the more serious this matter becomes for the ICCC.

 

Only problem I see with that is most the stuff purchased from David has to do with modified systems or modchips and I don't think the FTC or the ICCC would be to happy about that. I think for people like me who mainly bought modding parts or a debug console may be a bit out of luck with that course of action.

The people who sent him things for repair have a better chance.

 

I had a trade with David earlier this year which took months and months to resolve after paying immediately and being told it would be ready the next day. Excuses were always popping up going on about his kid being very sick and struggling with life around that etc. I took him at his word and after along time and a lot of requests for a refund eventually it got shipped and arrived, he did apologize for it all and asked me not to post on here with bad feedback etc which I agreed I wouldn't. However after reading all this and now wondering if hes scamming people I would just like to let people know to help understand his character a bit more. He did come across as a nice friendly guy however his excuses did get a bit old and he complained of financial issues to me.

 

He's looking more and more like a scammer every day.

 

I wonder if he has a facebook page. If so maybe contact some of his friends and not him at first to try and get some details about him. Which leads me to my first question. Is his name really david thomas or is dave thomas etc?

I'll check the county clerk and see who owns the home, assuming its not an apartment.

 

He's had my box of x3ce chips a x2.3 lite chip and a x2.1 PRO chip since JULY 14th. I got NOTHING in return. However, I have his home address, his hotmail account address and his ebay username...

 

Has anybody contacted the moderator about if david created another account on here to hide? I think we all need to take action against david. The person that said he lives close to him have you gone to his house? Ive emailed him several times and no response i cant believe he would do this to us!!! All i can say is he has some legal actions coming to him if he doesn't get back to us. We all need to back each other up on this matter so he doesnt get away with this!!!
