what sources are not original - there many source on this project:

1- for fpga: quartus project sources
2- for mcu: keil c51 sources
3- altium dsigner: scm and pcb sources
4- win 32 app: sources of builder c++

5- menu OS for ps1 sources - it's under developing. why sources for ps1 shoud be ORIGINAL if the task is pretty simple: SHOW text strings of images on SD card and put background picture, for example "waves"?
i can make it even on assembler - by using simple examples like PRINTGPU, dont kidding me that i cant use example from inet and send for everyone for free this menu OS w/ psio. i dont see any reasons use your code - with treading or whatever unnecessary things.

about legaly or not - explain me about for example EverDrives??? i see even separate threads over here on this site?? it's 100% legaly devices with soft, creator/author bought license for this or ask from SEGA/NINTENDO and etc???

anyway who wants use it - will buy it on own risk, it's not a secret that we are not company... everyone has a choice.
so dont tell me the tales ))) better go & Tell such Tales to Tails))))

Everdrive OS doesn't use any Nintendo Library. If your menu uses PsyQ, it's like using Xdk to release homebrews. You need an official licence to distribute your menu.
But if you use an legal devkit, there will be no problem.

i doubt that you or someone will really ask or care what i used for my menu. this question appear to fill empty space of critics. nobody talk about this question before couple guy became angry... so it's artificially generated question... it's my opinion. i see illegally every where - especially with mod chips, firmware for psp and etc...

but if you care where code from , - dont buy psio... or make menu yourself... i dont get why i cant make code even by PSY-Q end send it to you for free, and even with source code??? i every time repeat we sell hardware... so we dont get money from OS it's open source.

The "CFW" for psp is not illegal in the sense that having the tools to do it. It's the end user "launching the CFW app to modifiy the firmware" is where it goes technically against the ToS(?)

The sources for said CFW installers is all made using the homebrew sdk and nothing is illegal about it.

PSP is more of a gray area than illegal.

As for modchips, in some areas you are correct... some modchip providers do sell modchips with illegal code on them ( mainly because of their products/warehouse/company location.... or that there isn't an alternative ) but others actually either use some form of open source bios/firmware or include no bios/firmware and ask you as the end user to "go to the usual places".... that would be how they tread in the gray area.

I'm not trying to tell you how to bypass the whole illegal mess and get into a gray area....but rather that not everything you see is "illegal" ( I especially get a wee bit angry every time I see people use PSP as an example... )

btw - everdrive use dumps from cartriges i think it illegal things too, but nobody cares, and psio use images too ,.. so most hw emulators illegal from the start... anyway i do it for enjoy games, i do it mostly for myself. if some one would like buy - i can sell, like ppl trade on Ebay or at anyplace where ppl buy second hand things/ or home made... so you can chose yourself buy illegal things or not)))

The firmware doesnt contain dumps from carts. Users copy that to SD card themselves. Thats like saying by you selling PSIO, you are giving every person every ISO for the playstation - which obviously you arent.

PSIO firmware being free or not does not matter - you are using a user of this communities code, against the terms they released it. If you use it and distribute it (free, paid, doesnt matter) - you have to upload the source code. That is how the GPL works.

Hey, you asked... Don't need to be aggressive. You made the comparison with Everdrive, I told you the difference.
PsyQ isn't free. It's a stolen (leaked) devkit. Of course, Sony don't really care much, but releasing software built with it is still illegal. It is the same for Xbox and PS3 devkits which were leaked and used to create homebrews.

Modchips aren't illegal, it depends of the software on it, if it only allows imports, then it is not illegal.

You keep repeating you sell hardware only, but your device is useless without software. I don't know if your device is real or a hoax, and I really don't care. But everybody here is warning you about using GPL code without releasing the source, or using and selling software containing copyrighted code.

Release proper videos, with close up of the board, without shaky cams, change the game used (try one which is difficult to emulate), release a 1080p video, and maybe you'll stop getting «it's a hoax!» messages.

I have no dog in this fight, but I think you are missing the point he's trying to make here.

All these devices are, at best, in something of a grey area - it's reasonable to expect that a lot (or even most) people will use them for piracy, but that doesn't automatically make them illegal since there are arguably some non-infringing uses for them, too. But shipping a product that contains code built with PsyQ / SDevTC (and hence linked with the (c) Giant Enemy Crab libs) is not in a grey area at all - it's clearly copyright infringement.

Hence, doing this is rather like putting a big sign on your ass with "attack here for MASSIVE DAMAGE" marked on it - sure, it's quite probable that Sony wouldn't bother to do anything about it - but if they did, you have just made it really easy for them by doing something that's plainly illegal.

as always it hard to me to understand what APE meant.

well, and who will make disassembling executable files to chk for using PSY-Q? and what next - he goes to police or where... i cant imagine that someone wanna spent time for this.

we plan make better video, but now is time for summer))) i'm on journey for work in St. PetersBurg.

as i can get if i show source code of menu - i can dont care what code i use. anyway i need less think about such things at all , cause my goal is make workable/stable device. code of menu can be remake on assembler or using self made lib...

That's what we've been trying to tell you for what, 4 pages now? If you make it from scratch or whatnot then that is fine, if however you use GPL'd code then you must comply with the GPL license.
Make it from scratch and all is OK.

A lot of people are using there jump to conclusion mats. It either is a hoax, or he's running someone elses code, so pick a side(both can't be true). Wait until its released to pick it apart(if it ever gets released). Everything is vaporware till people start receiving units. He said he will be releasing the source code when the item is built. Lay off, and wait. Its like he's guilty until proven innocent. No one has been harmed yet, and he hasn't even made a profit, so quit complaining over symantics.

The way he handles himself warrants this kind of skepticism, quit assuming that we are jumping to conclusions.

I am pretty sure APE along with everyone else here finds themselves baffled at figuring out what you are trying to convey.

That and unless you're a native English speaker a lot of what I say comes off as cryptic.

I don't know why people try to discuss (or defend) for 8 pages someone that spend time for protecting "hardware side" of his project aganist chinese copy (LOOOOL) but steal someone code without thinking twice and unscrupulous...
Also your justification border on the ridiculous...
