    I know the fact that they are copies hurts him, but the data is out there, something that had no right to be out there. I know I would be pissed if I sent someone something, copy or not, and not only did they get to keep the disk, but they got their money back AND released the disk. I dont want Raylyd winning in this case either, but going and dumping the disk, after not sending them back, copies or not, isn't right either. Maybe its just me. Again, two wrongs not righting anything.

    Im not denying that everyone who bought a copy got scammed, they did. But they can't claim the moral high ground by getting everything they put into it back, and then some.

    Not wanting to make enemies here but do you personally own the rights to the beta's and unreleased games you own? I see no difference here... Truth is, nobody except Sega has the right to release a beta of Shenmue, end of story. Anyone in possession of a beta copy is infact in possession of something they probably shouldn't own in the first place - with few exceptions.

    The fact that someone took an 11 year old disc of a game made for a dead platform and released it is, I would say, a result!

    I could go on to say "I wish there were more like him..." but the truth is there are lots of people like him and the free sharing of old betas is getting better and better each and every year :)

    Hypothetically speaking, no the data on the GD-R had no right to be in public given it is inherently a copyright infringment. However, who cares?

    The Dreamcast is dead, SEGA kicks the Shenmue franchise around like a soccer ball made by dung beetles and the discs themselves probably weren't even allowed to leave the development studio in the first place.

    Not that any of it makes it legally OK. Morally though I can't really work up a sweat.

    Of course theres the fact that we shouldnt own any of this. I just know that I shouldn't have to live in fear that someone down the line is just going to file a chargeback and get the item and data, along with the money, leaving me out of everything. To me, yeah, buying the disks could be considered theft if you factor in that its Segas property. But adding upon that doesn't help either.

    Personally, I think the data is worth something, whether or not people agree or not. Those that don't shouldnt buy it in the first place, and those that feel the same way will. At this point, paying as a gift to Paypal is about the only way I can assure myself that I won't get scammed myself.

    Communistic ideals are nice but not feasible at all. Beta's aren't all that easy to get and are effectively stolen goods . You also have to take into account against your points that not all beta's come on CD'rs burnt years ago.

    dont see it as communism at all but i can see how it can be seen that way. very good point you had Cyantist on the non burnt discs which we wasnt discusing thou.

    Actually I think only like 2-4 people explicitly said they wanted a marketplace ban. I wasn't one of them though. A moderator simply needs to decide which ban to apply and do it.

    I think he has ethics issues and might not grasp them fully until now.

    Really his reputation is negative at this point and no one in their right mind would buy a beta from him.

    Him selling the discs as it was being discussed was what elevated this to where it is now.

    Plus not everyone has seen the thread or will see the thread. 6 months or a year later his profile needs to be marked like a bootleg CDr needs to be marked. All that needs to be done is to mark is footer or give him a special avatar like you did with the site donors.

    He needs a punishment that protects other users and makes others think twice. If you really want to hide behind a "I didn't know any better excuse" then so be it. You don't know any better so you can never sell on these forums or advertise anything you are selling elsewhere ever. Be careful what you wish for as you just might get it.
