I bought one on Amazon Marketplace just when it was announced but the seller backed out today claiming it's no longer in stock.

Oh, no shit... really?! Well I thought it was installing something to the system like the Wii with Homebrew channel and so. Cleared that up :)

Can companies get sued the by Nintendo for having exploitable software released? Or is it a grey area or something?

I would say that it's a gray area and it's not like he's leaking keys, like GeoHot with the PS3 3.55 FW back in the day

Yeah, they actually sent me an e-mail saying "We would like to ask you to please cancel the order from your side, as it will be faster and easier than if we cancel it from our side."

No way I'm going to do that.
Funny thing is, several hours after I bought it, their price for it actually increased. I guess they were trying to sell the copies they had at the higher price and now they're trying to get rid of the cheaper sales.

Considering that Nintendo is taking action for this game, pulling it from the Japan e-Shop, telling EB Games to remove the game from the shelf. Many staff are snapping them up and throwing them on eBay right now.
The word is getting out, sellers are now bumping prices up, people buying up to 10 copies if they find them. Some have the balls over here to charge $100+ for it.

It would be cheaper to buy Sky3DS and load a ROM. :)

I'm wondering if it will kill online use on the console though. I don't play online games, but I like to buy games on it, like the old Zelda and Mario...

I'd love to hack my 3ds, but I'd hate to loose games I bought off the shop and loose ability to buy from the shop

I don't expect Nintendo to block online play now, but in a future update It's possible that they will.

Well Nintendo's online isn't great anyway. The sync is just horrible. Nintendo don't want to spend the money on policing and making it stable, it's one thing Nintendo seem to always drop the ball on.

I went to a couple of UK video game stores, Game, CEX, Grainger Games and checked HMV and a cash converter type store the Gaming Stores out of stock in all stores and didn't see a copy in the CashGen. Cubic Ninja is like panning for gold

Saw several copies of Cubic Ninja today in a gameshop nearby.
I could be a scumbag and purchase them all, resell them for loads and get meself a nice XDK.
Fortunately, I'm not a lowlife so I just purchased one and left.

People that hoard exploitable games or consoles at launch to sell them on for quadruple or double the price (for consoles) disgust me.

I could get a few extra copies for people here if they want it.
No guarantee that I can get them but the price would be purchase price (a tenner ish) plus shipping.

Unfortunately, used copies are sold out, only new copies for 40 quid :c

    Here's a quick note:

The exploit is only for homebrew, and it will not be possible to hack games or run pirated ROMs with smealum's files.

If you have a 3DS that has a firmware version lower than 4.0, you can't use the homebrew exploit.

Also, Sky3DS only accepts 10 games, and you can't rewrite or change them when uploaded to the flashcart.

There are already some emulators and homebrew games that are being built that has the 3D support, including 3DSCraft (a Minecraft clone).

People are going nuts with Cubic Ninja, thankfully I got a copy for me months ago, for about R$30 ($12), only because of my interest of it's gameplay (lucky me!)...

The most funniest part is that most people doesn't even know who made/found the exploit and they are being guided mostly by hype and rumors.

The exploit is saved to the cart not the console

This reminds me of everyone going ape shit over Lego Indiana Jones for the Wii exploit years ago. Up to like £80 or something on eBay. Hilarious.
